Jimmy Masrin Bacakan Pledoi Pribadi: Tegaskan Tidak Ada Unsur Pidana Dalam Kasus LPEI

JAKARTA, PERKARANEWS.COM – Terdakwa III perkara dugaan korupsi pemberian fasilitas kredit oleh Lembaga Pembiayaan Ekspor Indonesia (LPEI) kepada PT Petro Energy, Jimmy Masrin, membacakan pledoi pribadinya di hadapan majelis hakim Pengadilan Tindak Pidana Korupsi Jakarta Pusat, Kamis (27/11/2025).

 

Dua terdakwa lainnya, yakni Dewi Nugroho dan Susi Mira Dewi Sugiarta, telah lebih dahulu membacakan pembelaan pada hari sebelumnya.

Dalam pembelaannya, Jimmy menyampaikan secara pribadi bahwa perkara yang menjeratnya bukan merupakan tindak pidana korupsi, melainkan persoalan bisnis dan hubungan perdata murni. Ia membuka pledoi dengan nada emosional dan penuh refleksi atas perjalanan hidup serta nilai-nilai moral yang dipegangnya.

 

“Saya berdiri di sini bukan untuk melawan hukum, tetapi untuk menyampaikan suara hati dan kebenaran, agar kiranya Majelis Hakim yang mulia dapat melihat perkara ini dengan kejernihan dan kebijaksanaan hati nurani,” ujar Jimmy di awal pledoinya.

 

Dalam bagian inti pledoi, Jimmy menegaskan bahwa dirinya tidak pernah memiliki niat jahat (mens rea) untuk merugikan keuangan negara. Ia menjabat sebagai Presiden Komisaris, bukan pengelola operasional PT Petro Energy, sehingga tidak terlibat dalam keputusan pencairan maupun penggunaan kredit.

“Kepercayaan bukanlah kelalaian, melainkan fondasi profesionalisme,” tegasnya.

 

Jimmy mengungkap bahwa ketika perusahaan mengalami kesulitan keuangan hingga dinyatakan pailit pada 2020, dirinya justru mengambil langkah tanggung jawab pribadi. Ia menyebut telah mengambil alih seluruh utang PT Petro Energy melalui PT Catur Karsa Mega Tunggal sebesar USD 60 juta, serta memberikan jaminan pribadi (personal guarantee) senilai USD 30 juta kepada LPEI.

 

“Langkah itu saya ambil bukan karena tekanan, tetapi sebagai wujud tanggung jawab moral dan kehormatan. Saya menyadari bahwa dalam budaya kita, utang adalah janji yang harus ditepati,” kata Jimmy.

 

Jimmy menyatakan kekecewaannya atas tuntutan jaksa yang menuntutnya 11 tahun penjara dan uang pengganti lebih dari USD 30 juta.

 

“Saya sangat terkejut dengan tuntutan yang begitu panjang. Terus terang sedih dan kaget, karena dari fakta persidangan tidak demikian,” ujarnya seusai sidang.

 

Dalam pledoinya, ia menyebut bahwa tidak ada satu rupiah pun dana hasil pencairan kredit LPEI yang diterima atau dinikmati dirinya secara pribadi. Bahkan ahli penuntut umum sendiri mengakui tidak ditemukan aliran dana yang mengarah ke rekening pribadinya.

 

Jimmy juga menyoroti perhitungan keuangan yang dinilainya keliru. Berdasarkan data kurs tengah Bank Indonesia, katanya, LPEI justru memperoleh keuntungan kurs sebesar Rp455,5 miliar, bukan kerugian.

 

Kuasa hukum Jimmy Masrin, Soesilo Aribowo dan Waldus Situmorang, menegaskan bahwa perkara yang dituduhkan kepada kliennya lebih tepat dikategorikan sebagai hubungan perdata akibat wanprestasi korporasi, bukan tindak pidana korupsi.

 

“Ini kasus perdata, karena ini murni hubungan bisnis antara lembaga pembiayaan dan debitur. Kalau pun ada masalah, itu wanprestasi, bukan pidana,” ujar Soesilo seusai sidang.

 

Soesilo menjelaskan, sejak 2021 hingga kini, cicilan utang PT Petro Energy masih berjalan lancar. Ia juga menyoroti peran Jimmy yang terbatas sebagai komisaris.

 

“Penuntut umum mengambil tempus 2015–2019, padahal setelah itu cicilan masih berjalan dan tidak macet. Ini bukti bahwa perjanjian masih hidup dan bersifat perdata. Selain itu Pak Jimmy ini Presiden Komisaris, fungsinya pengawasan, bukan operasional. Jangan karena tanda tangan dianggap salah — harus dilihat dulu apakah ada niat jahatnya atau tidak,” jelasnya.

 

Sementara Waldus Situmorang menambahkan, secara finansial, LPEI justru memperoleh keuntungan, bukan kerugian sebagaimana didalilkan jaksa.

 

“Kalau dijumlahkan sampai akhir pembayaran tahun 2028, LPEI justru akan menerima Rp1,2 triliun dari utang yang nilainya hanya Rp844 miliar. Jadi tidak ada kerugian negara, bahkan ada surplus,” jelasnya.

 

Dalam pledoi tim kuasa hukum yang dibacakan sebelumnya, pembela menyusun nota setebal 1.500 halaman berisi delapan bagian, mulai dari pendahuluan hingga analisis hukum. Poin utamanya menegaskan bahwa:

1. LPEI adalah badan hukum mandiri, bukan bagian dari keuangan negara, sehingga kerugiannya tidak dapat disebut “kerugian negara”.

2. Jimmy Masrin tidak menerima atau menikmati dana hasil pembiayaan.

3. Seluruh kredit digunakan untuk kegiatan operasional perusahaan.

4. Tidak terpenuhi unsur perbuatan melawan hukum dan memperkaya diri sendiri sebagaimana Pasal 2 ayat (1) UU Tipikor.

5. Terdakwa justru memiliki itikad baik dengan menjamin pembayaran utang melalui debitur baru.

 

Dalam salah satu kutipan pledoi, kuasa hukum menyampaikan:

“Tindakan yang dilakukan oleh Terdakwa III tidak termasuk kualifikasi sebagai perbuatan melawan hukum. Tidak terbukti adanya niat atau mens rea dari Jimmy Masrin untuk melakukan perbuatan melawan hukum.”

 

Jimmy menutup pembelaannya dengan pernyataan penuh emosi dan kejujuran moral.

“Saya mohon kepada Yang Mulia Majelis Hakim untuk melihat perkara ini secara utuh: sebagai persoalan bisnis yang gagal, bukan tindak pidana. Saya tidak mencari keuntungan pribadi, saya justru berupaya menyelamatkan perusahaan.”tegasnya

“Siapa bersih kelakuannya, aman jalannya; tetapi siapa berliku-liku jalannya, akan diketahui.”tambahnya.

 

Jimmy berharap majelis hakim memberikan putusan yang adil dan memulihkan nama baiknya.

 

“Saya ingin menutup hidup saya dengan nama baik yang bersih, bukan noda dari tuduhan yang tidak saya lakukan.”pungkasnya.

 

Sidang perkara LPEI–PT Petro Energy ini menjadi salah satu kasus korporasi terbesar yang kini tengah disorot publik, mengingat implikasinya terhadap hubungan hukum antara lembaga pembiayaan negara dan korporasi swasta dalam praktik bisnis nasional. (AR)
