PANGKALPINANG,PERKARANEWS – Jaksa Penuntut Umum (JPU) menghadirkan empat staf Kementerian Perdagangan (Kemendag) sebagai saksi dalam sidang kasus dugaan korupsi importasi gula dengan terdakwa Thomas Trikasih Lembong (Tom Lembong) di Pengadilan Tipikor, Jakarta Pusat, Senin (24/3/2025). Para saksi tersebut adalah Susy Herawaty, Robert J. Indarto, Yoshi Evelyn Nanthania Dianza, dan Nurimansyah.
Robert, yang pensiun pada 2019, terakhir menjabat sebagai Sekretaris Inspektorat Jenderal di Kemendag. Susy Herawaty saat ini menjabat sebagai Staf Ahli Bidang Manajemen, Tata Kelola, dan Hubungan Antarlembaga Kemendag. Nurimansyah kini menjabat sebagai Kepala Pusat Data dan Sistem Informasi di Kemendag, sedangkan Yoshi adalah PNS Kemendag.
Tom Lembong didakwa merugikan keuangan negara sebesar Rp 578.105.411.622,47. Perhitungan tersebut berdasarkan Laporan Hasil Audit Penghitungan Kerugian Keuangan Negara Atas Dugaan Tindak Pidana Korupsi Dalam Kegiatan Importasi Gula Di Kementerian Perdagangan Tahun 2015 sampai 2016 Nomor PE.03/R/S-51/D5/01/2025 bertanggal 20 Januari 2025. Laporan itu dikeluarkan oleh Badan Pengawasan Keuangan dan Pembangunan (BPKP).
Dalam keterangannya, Susy menyatakan adanya izin impor yang dibuat tanpa rapat koordinasi terbatas (Rakortas) antarkementerian. Kebijakan itu dibuat pada 2017 dan merupakan perintah pimpinan, dalam hal ini Direktur Perdagangan Luar Negeri, Kemendag. “Berjenjang, saya perintah dari direktur, tapi saya sudah sampaikan dari kondisi ketidakadaan rakortas tadi,” ucap Susy. “Susy juga menyampaikan kepada pimpinan bahwa ini tidak memenuhi, namun kemudian Direktur mengatakan ini adalah perintah bapak menteri,” tambah Susy.
Dalam dakwaan, Tom Lembong disebut tidak melakukan pengendalian atas distribusi gula dalam rangka pembentukan stok gula dan stabilisasi harga gula yang seharusnya dilakukan oleh BUMN melalui operasi pasar dan/atau pasar murah. Tom disebut tidak menunjuk perusahaan BUMN untuk pengendalian ketersediaan dan stabilisasi harga gula, tetapi menunjuk Induk Koperasi Kartika (Inkopkar), Induk Koperasi Kepolisian Negara Republik Indonesia (Inkoppol), Pusat Koperasi Kepolisian Republik Indonesia (Puskopol), dan Satuan Koperasi Kesejahteraan Pegawai (SKKP) TNI-Polri. Jaksa juga menyebutkan, Tom menerbitkan surat persetujuan impor gula kristal mentah (GKM) tanpa dasar rapat koordinasi antarkementerian.
JPU dalam keterangannya, Tom Lembong selaku Menteri Perdagangan periode 2015-2016 telah menerbitkan 21 persetujuan impor gula kristal mentah (GKM) dalam rangka penugasan pembentukan stok gula dan stabilitas harga gula kepada 10 pengusaha. JPU menyebut, penerbitan persetujuan impor itu dilakukan tanpa disertai rekomendasi Kementerian Perindustrian.
Atas dasar hal tersebut, Tom Lembong didakwa melanggar Pasal 2 ayat (1) atau Pasal 3 juncto Pasal 18 Undang-Undang Nomor 31 Tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi sebagaimana telah diubah dengan Undang-Undang Nomor 20 Tahun 2001 (UU Tipikor) Pasal 55 ayat (1) ke-1 Kitab Undang-Undang Hukum Pidana (KUHP).
