Dianggap Melawan Hukum, Gubernur Babel akan Digugat PT. Pulau Mas Sentosa

PANGKALPINANG – Perkaranews.com, Setelah melayangkan gugatan pembatalan surat keputusan terkait pencabutan Izin Lingkungan dan Izin Berusaha ke Pengadilan Tata Usaha Negara (PTUN) Pangkalpinang pada 12 Oktober 2021, PT. Pulomas Sentosa kembali tengah mempersiapkan untuk menggugat Gubernur Kepulauan Bangka Belitung, Erzaldi Rosman Djohan. Kali ini Pemerintah Provinsi Bangka Belitung, Cq. Gubernur untuk digugat dalam perkara gugatan Perbuatan Melawan Hukum (PMH) ke Pengadilan Negeri Pangkalpinang.

Kuasa Hukum PT. Pulomas Sentosa, Sumin, SH didampingi Hendra Irawan, SH, MH dalam keterangan tertulis yang diterima wartawan mengatakan, pihaknya telah menerima Surat Kuasa Khusus dari Direktur PT. Pulomas untuk kembali menggugat Gubernur Babel akibat pencabutan ijin yang telah merugikan pihak pulomas dan masyarakat nelayan akibat alur muara tidak dapat dipergunakan nelayan Sehingga dalam waktu dekat akan mendaftarkan gugatan ke Pengadilan Negeri Pangkalpinang.

“Surat gugatan sedang kita persiapkan, kita sudah mendapat surat kuasa khusus dari klien kita PT. Pulomas Sentosa untuk menggugat lagi Gubernur Babel. Jika sebelumnya kita menggugat gubernur ke PTUN, sekarang kita gugat lagi Perbuatan Melawan Hukum yang diduga dilakukan gubernur ke Pengadilan Negeri Pangkalpinang. Dan dalam waktu segera akan kita daftarkan gugatan tersebut ke pengadilan,” ungkap Sumin.

Menurutnya, gugatan PMH dilayangkan kepada Gubernur Babel masih terkait dengan pencabutan Izin Berusaha dan Izin Lingkungan yang dilakukan terhadap Pulomas. Hal ini dilakukan karena gubernur dinilai telah bertindak sewenang-wenang sehingga merugikan pihak perusahaan. Termasuk merugikan puluhan karyawan dan pekerja yanng menggantungkan hidupnya di PT. Pulomas.

Berawal dari itulah, kebijakan dan perbuatan gubernur yang menghentikan kegiatan perusahaan sepihak adalah perbuatan melawan hukum dan merugikan sebagaimana diatur dalam Pasal 1365 KUHPerdata. Karena muncul kerugian maka gugatan akan kita layangkan,” papar Hendra Irawan.

Mengenai bentuk kerugian dan apa saja perbuatan-perbuatan gubernur yang dianggap melawan hukum oleh PT Pulomas, Hendra menyebutkan hal itu kelak akan dirinci lebih lanjut dalam format gugatan. Termasuk tentang besaran ganti kerugian yang akan diminta pihaknya dalam petitum gugatan.

“Ini sebagai pembelajaran buat semua kepala daerah di Indonesia, juga di Bangka Belitung bahwa tidak harus bertindak sewenang-wenang meskipun memiliki wewenang untuk itu. Karena masih ada hukum sebagai panglima di negeri ini. Negara kita ini negara hukum, jangankan cuma gubernur, pejabat di atasnya pun tidak menutup kemungkinan melakukan perbuatan melawan hukum dan dapat digugat juga.
