Kasus Sengketa Lahan Makin Panas: Winda Asriany Bongkar Dugaan Manipulasi Bukti oleh PT. Kharisma Alam Persada di Persidangan

JAKARTA, PERKARANEWS.COM – Kasus Winda Asriany ini menjadi sorotan publik, setelah tanah yang dimilikinya secara sah diserobot oleh PT. Kharisma Alam Persada. Sebelumnya pada Selasa (24/6/2025), Winda telah melaporkan tiga Hakim dan Panitera Pengadilan Negeri (PN) Rantau ke Komisi Yudisial (KY), yang didasarkan pada dugaan pelanggaran kode etik selama proses persidangan perkara perdata sengketa lahan.

 

Para Hakim yang dilaporkan ialah Majelis Hakim yang memeriksa dan memutus perkara tersebut terdiri dari Ketua Majelis Hakim Achmad Iyud Nugraha, serta Hakim Anggota Dwi Army Okik Arissandi dan Fachrun Nurrisya Aini, serta Panitera Pengganti Mulyadi.

Kali ini Winda mendatangi Badan Pengawas (Bawas) Mahkamah Agung (MA), guna mengajukan bukti tambahan atas laporan yang telah disampaikan sebelumnya. Laporan tersebut terdaftar dengan nomor NHMQU20250616OZ dan mencakup pelanggaran kode etik yang diduga dilakukan oleh majelis hakim Pengadilan Negeri (PN) Rantau.

 

Winda menyampaikan kepada Bawas bahwa selama proses sidang di PN Rantau, dirinya dan kuasa hukumnya tidak pernah dihadirkan saat pemeriksaan bukti tertulis asli milik PT. Kharisma Alam Persada yang nota bene sebagai penggugat lawan dalam persidangan. Winda menyebut Ketua Majelis Hakim Iyud Nugraha, merubah jadwal sidang sehingga mereka tidak bisa hadir dan mengajukan keberatan terhadap keaslian bukti tersebut. Dua bukti kunci perusahaan yang dipertanyakan Winda adalah Surat Keterangan Kepemilikan Tanah (SKKT) dan sebuah kwitansi notaris.

 

“Kami tidak pernah melihat aslinya saat proses sidang, disebabkan ada unsur kesengajaan hakim mengubah-ubah jadwal sidang supaya kami tidak hadir. Hari itu kami sudah mengajukan keberatan agar kami hadir tapi tidak diindahkan oleh hakim, ketua hakim yaitu Iyud Nugraha,” ungkap Winda kepada sejumlah awak media di Gedung Badan Pengawasan MA RI, Jumat (4/7/2025).

 

Menurut Winda,  kedua bukti tersebut diyakini palsu. Dalam SKKT disebut memiliki tiga versi berbeda: satu tanpa nomor surat, satu tanpa tanda tangan dan satu lagi dengan nomor dan tanda tangan. Sementara kwitansi notaris yang diklaim sebagai bukti pembayaran balik nama disebut tanggal 10 Juli. Winda menilai hal tersebut tidak logis, karena proses jual beli tanah terjadi pada 1 Agustus. Meski diragukan keasliannya, bukti-bukti inilah yang menjadi dasar hakim memenangkan perusahaan dan menyatakan Sertifikat Hak Milik (SHM) Winda tidak mengikat secara hukum

 

“Gak mungkin kita bayar notaris dulu baru beli tanahnya. Itu tidak valid dan tidak otentik,” terangnya.

 

Selanjutnya Winda juga mengungkapkan bahwa ia telah bertemu dengan seorang oknum di Mahkamah Agung (MA). Dalam pertemuan tersebut, Winda menceritakan bahwa dirinya ditawarkan jaminan kemenangan dalam proses kasasi yang sedang berlangsung, dengan syarat biaya operasional sebesar Rp2 miliar.

 

“Saya sebagai rakyat biasa yang sah sebagai pemilik tanah, merasa sangat dirugikan. Bagaimana mungkin saya harus membayar biaya operasional sebesar itu untuk mendapatkan keadilan?” ungkap Winda dengan sesekali menyeka air matanya.

 

Lebih lanjut Winda juga menuturkan bahwa dalam bukti tambahan yang disampaikan, Winda menjelaskan bahwa suaminya (John Akang Saragih), saat itu bekerja di perusahaan termohon kasasi. Ia juga menegaskan bahwa tidak ada dokumen yang menunjukkan bahwa aset perusahaan tersebut dibaliknamakan kepada suaminya.

 

“Kami menduga ada penggelapan pajak yang dilakukan oleh pihak PT. Kharisma Alam Persada,” tandasnya.

 

Winda berharap agar Bawas MA dapat memantau proses kasasi yang sedang berlangsung dan memastikan bahwa masih ada keadilan di Republik Indonesia yang dapat ditegakkan.

 

“Kami mengharapkan putusan yang adil yang memenangkan kami sebagai pemilik sah tanah SHM No. 76, 77, dan 78,” pungkasnya.
