PANGKALPINANG, PERKARANEWS.COM – Drama berkepanjangan terkait implementasi kebun sawit plasma dan status lahan di luar Hak Guna Usaha (HGU) milik PT Sawindo Kencana kembali memanas. Hal ini terungkap dalam Rapat Dengar Pendapat (RDP) yang digelar di Ruang Badan Musyawarah DPRD Babel pada Senin, (3/11/2025).
RDP yang dipimpin oleh Ketua DPRD Babel Didit Srigusjaya dan Edi Iskandar ini mendengarkan secara langsung keluh kesah dan laporan dari Kepala Desa (Kades) dan perwakilan masyarakat Kabupaten Bangka Barat (Babar) terkait perusahaan sawit yang diduga melanggar aturan.
Salah satu suara yang lantang adalah Kepala Desa Buyan Kelumbi, Arlan Densi. Ia mengungkapkan gejolak yang tak kunjung usai terkait kebun PT Sawindo Kencana yang berada di luar HGU.
“Kronologisnya, kami mengetahui laporan dari Sawindo Kencana sendiri ke desa, adanya lahan di luar HGU melalui surat. Mereka meminta desa memberikan rekomendasi agar mereka bisa mengelola kebun di luar HGU tersebut,” beber Arlan Densi.
Arlan menjelaskan bahwa permintaan rekomendasi itu sontak menimbulkan gejolak di desa. Badan Permusyawaratan Desa (BPD) dan masyarakat menolak tanpa adanya kerjasama atau kesepakatan yang jelas.
“Bagi kami, lahan di luar HGU itu, ada juga hak kami di situ. Intinya, kami meminta kebun yang di luar HGU ini tolong dikeluarkan dan kembalikan ke desa, apakah berbentuk plasma atau bagaimana,” tegasnya.
Pergerakan masyarakat dan desa berlanjut hingga tahun 2018, melalui serangkaian RDP yang pada akhirnya mencapai meja Gubernur. Hasilnya, terciptalah sebuah Memorandum of Understanding (MOU) bagi hasil 65:35 antara PT Sawindo Kencana dan desa.
MOU tersebut mengatur agar hasil pengelolaan lahan seluas ribuan hektar yang berada di luar HGU dimasukkan ke rekening BUMDes (Badan Usaha Milik Desa) dan dikelola oleh BUMDes, yang saat itu difasilitasi oleh mantan Gubernur Babel Erzadi.
Ironisnya, kini MOU yang disepakati oleh Kadisbun, Kadinas PMD Babar, hingga Kadis Prop Babel (Budi Utama) tersebut justru dinyatakan ilegal dan bermasalah oleh pihak-pihak tertentu.
“Uang yang selama ini dari perusahaan Sawindo Kencana masuk ke rekening BUMDes, itu mereka nyatakan tidak halal dan akan diproses. Kami dilarang menggunakan uang tersebut,” ungkap Arlan Densi dengan nada bingung.
Yang memperparah situasi, Arlan Densi menyebutkan bahwa pihak Aparat Penegak Hukum (APH) Kejaksaan Negeri Bangka Barat melarang desa menggunakan anggaran tersebut sampai hari ini.
Situasi ini menciptakan kebingungan di tingkat desa. Di satu sisi, pimpinan BPN Bangka Barat saat ini menyatakan HGU perusahaan adalah sah. Namun, di sisi lain, Kejaksaan Babar melarang penggunaan dana bagi hasil dari lahan di luar HGU tersebut.
“Kami sebagai kepala desa, pemerintah di desa, agak bingung. Sementara yang kami harapkan, mereka yang mengerti dengan hukum dan aturan, malah simpang siur,” keluhnya.
Arlan Densi menyimpulkan bahwa dana hasil bagi hasil lahan non-HGU ini telah menjadi “perangkap” bagi desa. Ia mengungkapkan, pihak Kejaksaan Babar berargumen bahwa kebun di luar HGU itu bukan milik Sawindo dan juga bukan milik desa karena desa belum punya alas hak.
“Anggapan mereka, ini tanah negara. Dan kami antar desa dengan Sawindo haram melakukan kerja sama di atas tanah negara yang tidak berhak. Sampai mereka mengeluarkan larangan dana itu tidak boleh digunakan dulu,” jelasnya.
Menutup laporannya, Arlan Densi memohon kejelasan kepada pemerintah dan DPRD: “Tolonglah kami, jangan sampai kami tersandera oleh hal-hal semacam ini. Kalau memang itu hak kami, di kebun di luar HGU itu, tolong beri kepada kami. Tapi pada dasarnya, apakah boleh perusahaan berkebun di luar HGU? Itu saja.”tutupnya. (Yuko)
