JAKARTA,PERKARANEWS.COM– Sebuah dugaan Tindak Pidana Korupsi (Tipikor) dengan modus pengadaan sanggar-sanggar fiktif untuk pencairan dana pagelaran seni dan budaya, kini tengah bergulir di Pengadilan Tipikor Jakarta Pusat. Perkara yang teregister dengan nomor 56/Pid.Sus-TPK/2025/PN Jkt.Pst ini, diduga merugikan negara lebih dari Rp150 miliar berdasarkan nilai kegiatan dalam dokumen anggaran APBD Tahun 2023.
Dalam pusaran kasus ini, mantan Kepala Dinas Kebudayaan (Disbud) DKI Jakarta, Iwan Henry Wardhana, bersama dua orang lainnya, yakni eks Kabid Pemanfaatan M Fairza Maulana, dan pihak swasta berinisial Gatot Arif Rahmadi (pemilik Event Organizer (EO) Booth Produksi/GR PRO), telah menjadi terdakwa. Sidang dengan agenda pembacaan Nota Keberatan (Eksepsi) digelar pada Selasa (24/6/2025).
Pada persidangan sebelumnya, Selasa (17/6/2025), Jaksa Penuntut Umum (JPU) telah menyampaikan dakwaan kepada ketiga terdakwa. Mereka dituding melanggar sejumlah regulasi, termasuk UU No. 28 Tahun 1999 tentang Penyelenggaraan Negara yang Bersih dan Bebas dari Korupsi, Kolusi dan Nepotisme, serta Peraturan Presiden RI No. 12 Tahun 2021 tentang Pengadaan Barang/Jasa Pemerintah.
Selain itu, pengadaan kegiatan fiktif ini juga disebut melanggar Peraturan Daerah Provinsi DKI Jakarta Nomor 5 Tahun 2007 tentang Pokok-Pokok Pengelolaan Keuangan Daerah, dan Peraturan Lembaga Kebijakan Pengadaan Barang/Jasa Pemerintah Nomor 8 Tahun 2018 tentang Pedoman Swakelola.
Usai sidang eksepsi, Ezar Ibrahim selaku Penasihat Hukum Terdakwa Iwan Henry Wardhana, menyatakan keberatannya atas dakwaan JPU.
“Kami sampaikan terkait keberatan dari berbagai rangkaian cerita, banyak hal lah, misalnya adanya arahan, ternyata itu tidak pernah ada. Serta penerimaan uang Rp50 juta juga tidak pernah ada. Pernyataan dari terdakwa lain tidak konsisten,” jelas Ezar kepada awak media.
Ezar berharap agar Majelis Hakim dalam Putusan Sela nanti, dapat membebaskan Pasal 2 dari dakwaan JPU.
“Dalam Putusan Sela, kami berharap Majelis Hakim melepaskan Pasal 2 yang menjadi dakwaan JPU,” pungkas Ezar.
Dalam dakwaan JPU, ketiga terdakwa dijerat dengan pasal berlapis, yaitu Pasal 2 ayat (1), Pasal 3, Jo. Pasal 18 ayat (1) UU Nomor 20 Tahun 2001 tentang Perubahan Atas Undang-Undang Republik Indonesia Nomor 31 Tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi Jo. Pasal 55 ayat (1) ke-1 KUHP Jo.
