JAKARTA, PERKARANEWS.COM — Sidang lanjutan perkara dugaan tindak pidana penyalahgunaan narkotika yang menjerat Muhammad Amar Akbar alias Ammar Zoni dan lima terdakwa lainnya, yakni, Asep, Ardian Prasetyo, Andi Mualim, Ade Candra Maulana, dan Muhammad Rivaldi. Kembali digelar di Pengadilan Negeri Kelas 1A Khusus Jakarta Pusat, Kamis (4/12/2025).

 

Persidangan yang dipimpin Hakim Ketua Elyarahma Sulistyowati SH ini mengagendakan pemeriksaan saksi dari Jaksa Penuntut Umum (JPU), dengan rencana menghadirkan para terdakwa secara langsung di ruang sidang.

Namun, arahan majelis hakim agar Ammar cs dihadirkan secara offline kembali tidak dapat terlaksana. Saat membuka sidang, Hakim Ketua Dwi Elyarahma memerintahkan JPU untuk menghadirkan para terdakwa.

 

“Silakan Penuntut Umum menghadirkan Terdakwa,” ujar hakim ketua.

 

Namun Jaksa menjelaskan bahwa upaya menghadirkan Ammar dkk telah dilakukan, termasuk mengirim surat permohonan pemindahan sementara dari Lapas Khusus Kelas IIA Karanganyar, Nusakambangan, ke Lapas Narkotika Jakarta.

 

Jaksa kemudian membacakan isi balasan surat dari Direktorat Jenderal Pemasyarakatan (Ditjen PAS), yang menyatakan bahwa permohonan tersebut belum bisa dipenuhi.

 

“Permohonan pemindahan sementara narapidana Asep alias Cecep bin Sarikin dan kawan-kawan dari Lapas Khusus Kelas IIA Karanganyar, Nusakambangan, Jawa Tengah, ke Lapas Narkotika Kelas IIA Jakarta… belum dapat dipenuhi,” ujar jaksa Andri Saputra.

 

Ia menjelaskan beberapa alasan penolakan tersebut, yaitu: pertimbangan aspek keamanan, efisiensi pelaksanaan persidangan, dan efektivitas waktu.

Tapi setelah sidang dibuka, ternyata jaksa penuntut umum tidak bisa menghadirkan para terdakwa ini dengan keputusan dari Dirjen PAS, menolak permohonan untuk dihadirkan di ruang persidangan.” terang Devita.

 

Devita menegaskan bahwa kehadiran terdakwa adalah bagian dari hak pembelaan penasehat hukum dan terdakwa.

 

“Pastinya kami sebagai penasehat hukum tetap mau para terdakwa ini dihadirkan di persidangan, karena bagaimanapun itu adalah hak dari para terdakwa.” ujarnya.

 

Devita menambahkan bahwa wewenang menghadirkan terdakwa sepenuhnya berada pada Jaksa Penuntut Umum. Oleh karena itu, ia mendorong JPU untuk kembali berkoordinasi dengan Kemenkumham.

 

“Sebenarnya kami ini meminta kepada jaksa penuntut umum untuk bisa menyurati Kemenkumham untuk bisa menghadirkan para terdakwa di persidangan.” katanya.

 

Ia menegaskan pihaknya akan terus memantau dan berkoordinasi agar Lapas Karanganyar memfasilitasi kehadiran para terdakwa sesuai arahan majelis hakim. (AR)
