Ahli Hukum Pidana Ungkap Unsur Pertanggungjawaban Pidana dalam Sidang Gratifikasi Ketua PN Surabaya Rudi Suparmono

JAKARTA,PERKARANEWS.COM– Sidang perkara dugaan gratifikasi yang menyeret nama Rudi Suparmono, mantan Ketua PN Surabaya (kini Ketua PN Jakarta Pusat), kembali bergulir di Pengadilan Tipikor, Jakarta Pusat, Senin (14/7/2025). Jaksa Penuntut Umum (JPU) menghadirkan Prof. Agus Surono, seorang ahli Hukum Pidana Universitas Pancasila, untuk memberikan keterangan penting terkait unsur-unsur pertanggungjawaban pidana.

​Rudi Suparmono didakwa menerima gratifikasi dari pengacara Lisa Rachmat terkait penanganan perkara Gregorius Ronald Tannur. Kasus ini tercatat dengan nomor perkara 54/Pidsus-TPK/2025/PN JKT.PST.

​Dalam kesaksiannya di hadapan Majelis Hakim, Agus Surono menjelaskan bahwa seseorang dapat dimintai pertanggungjawaban pidana apabila seluruh unsur tindak pidana terpenuhi. “Kalau semua unsur tersebut terpenuhi, maka hal itu bisa dimintai pertanggungjawaban atas perbuatan yang dilakukan oleh subjek tindak pidana tadi,” terang Agus.

​Unsur-unsur yang dimaksud meliputi: subjek tindak pidana, adanya perbuatan yang divalidasi sebagai perbuatan bersalah menurut ketentuan pidana, adanya kecakapan untuk melakukan suatu perbuatan pidana, dan tidak adanya alasan penghapus pidana.

​Hakim anggota Adi Saputra kemudian mengajukan pertanyaan krusial kepada ahli Agus Surono mengenai konsep “Meeting of the Minds”. ​”Mens rea itu sulit untuk diukur, maka yang bisa dinilai adalah Actus reus,” jelas Agus. Ia menegaskan bahwa actus reus dapat dinilai dari perbuatan yang menyimpang dari tujuan utamanya. “Dinilai dengan perbuatan yang menyimpang dari tujuannya, maka masuk dalam kualifikasi dalam perbuatan pidana,” pungkasnya.

Dalam dakwaan JPU, terungkap bahwa selama menjabat sebagai Ketua Pengadilan Negeri Surabaya Kelas I A Khusus dan Ketua Pengadilan Negeri Jakarta Pusat Kelas I A Khusus, terdakwa Rudi Suparmono diduga telah menerima uang yang berkaitan langsung dengan jabatannya.(Yuko)
