BANGKA BARAT,PERKARANEWS.COM-Konflik lahan antara petani dan Pemerintah Kabupaten Bangka Barat memasuki babak baru. Petani menggugat Pemkab atas dugaan penyerobotan lahan, sementara Kepala UPTD Balai Pertanian ‘dicecar’ hakim karena tidak dapat menunjukkan bukti tapal batas lahan.
Ketegangan terkait sengketa lahan di Bangka Barat semakin meningkat. Masyarakat petani yang tergabung dalam LBH MBK menggugat Pemerintah Kabupaten Bangka Barat atas dugaan penyerobotan lahan di Lambow, Kelurahan Kelapa.
Tak hanya itu, Kepala UPTD Balai Pertanian Bangka Barat menjadi sorotan setelah ‘dicecar’ oleh Hakim Pengadilan Tata Usaha Negara (PTUN) Pangkalpinang karena tidak dapat menunjukkan bukti tapal batas lahan aset Pemkab seluas 120 hektar.
Rudi Sitompol, kuasa hukum petani Lambow Kelapa dari LBH MBK, menyoroti adanya beberapa petani yang memiliki alas hak di kantor lurah dan satu petani yang memiliki Sertifikat Hak Milik (SHM) seluas 5000 m². Ia mempertanyakan dasar pengukuran lahan yang dilakukan oleh BPN.
“Petani sudah menggarap lahan ini secara turun-temurun selama 20 tahun. Mereka tidak tahu kapan pengukuran dilakukan, kapan patok dipasang. Saat persidangan, terungkap bahwa saksi yang dihadirkan bukan petani yang menggarap lahan,” cetusnya.
Rudi juga menyoroti perbedaan luas lahan yang signifikan. Dari 5,6 hektare yang dialihkan ke Pemda Bangka Barat pada tahun 2003, menjadi 120 hektare berdasarkan pengukuran UPTD.
“Hakim meminta kami menyiapkan aset yang akan disita. Kami akan terus berjuang untuk keadilan petani,” tegasnya.
Hakim PTUN Pangkalpinang, Surya Febry Tias, bahkan sempat mengeluarkan nada tinggi kepada Kepala Unit Pelaksana Teknis Daerah (UPTD) Balai Pertanian Kelapa, Zahroni. Hal ini dikarenakan Zahroni tidak dapat menunjukkan tapal batas lahan Lambow.
“Saya mau tanya, mana tapal batas lahan Lambau, jangan asal tunjuk aja, harus ada buktinya,” kata Hakim Surya Febry Tias dengan nada tinggi.
Kepala UPTD Balai Pertanian Kelapa, Zahroni pun terlihat tidak berkutik ketika Hakim PTUN Pangkalpinang turun ke Lambow. Ia tidak dapat menunjukkan bukti secara akurat terkait klaim sepihak atas lahan milik warga.
Salah satu staf Badan Pertanahan Nasional (BPN) yang ditemui di lokasi mengungkapkan bahwa pihaknya belum pernah menerbitkan sertifikat terkait lahan Lambow.
Menurutnya, sertifikat yang diterbitkan oleh BPN hanya untuk sekolah dan kantor milik Pemerintah Provinsi Bangka Belitung.
“Kami dari BPN tidak pernah mengeluarkan sertifikat atas lahan Lambau seluas 100 hektar tersebut hingga sekarang,” tegas Ibnu Hajar kepada awak media saat sidang lapangan.
Kasus ini bermula pada tahun 2017 lalu, di mana Pemkab Babar berencana menindaklanjuti kerja sama antara Pemkab Bangka Barat dengan Pemprov DKI Jakarta dalam bidang peternakan sapi. Pemprov DKI akan memberikan 500 ekor sapi betina produktif, serta bantuan lainnya senilai Rp 9,624 miliar. Namun, program ini terkendala masalah lahan di Lambow Kelapa dan gagal dilaksanakan, kini menyisakan permasalahan baru di masyarakat.
Kasus sengketa lahan ini masih terus bergulir dan menjadi perhatian masyarakat Bangka Barat. Masyarakat menuntut keadilan dan penyelesaian yang transparan atas konflik yang telah berlangsung selama bertahun-tahun ini.(Yuko)
