PANGKALPINANG,PERKARANEWS.COM – Mahkamah Konstitusi (MK) akhirnya memutuskan bahwa Pemilihan Kepala Daerah (Pilkada) Bangka Barat terbukti mengandung praktik politik uang. Hakim MK Suhartoyo mengungkapkan kronologi faktual berdasarkan keterangan saksi dari pemohon, Rizaldi, dalam sidang pembacaan putusan yang digelar pada Senin (24/2).
Rizaldi, yang merupakan koordinator desa di Sinar Manik, Jebus, mengungkapkan adanya pemberian uang kepada 148 pemilih melalui koordinator di masing-masing Tempat Pemungutan Suara (TPS) dengan tujuan memenangkan pasangan calon nomor urut 2.
“Saksi Rizaldi, yang merupakan koordinator desa, menerima uang sebesar 11 juta rupiah untuk diserahkan kepada 148 pemilih di 4 TPS di Desa Sinar Manik,” ujar Suhartoyo.
MK berkesimpulan bahwa praktik politik uang telah mencederai kemurnian hasil perolehan suara pemilihan kepala daerah Kabupaten Bangka Barat tahun 2024.
Putusan MK ini tentu saja mengejutkan banyak pihak. Masyarakat Bangka Barat pun memberikan reaksi beragam. Ada yang mendukung putusan tersebut karena dianggap sebagai langkah penegakan hukum yang tegas. Namun, ada pula yang menyayangkan pembatalan hasil Pilkada karena dianggap merugikan proses demokrasi.
Pelaku politik uang dalam pemilihan Gubernur dan Wakil Gubernur, Bupati dan Wakil Bupati, serta Walikota dan Wakil Walikota, diatur dalam Undang-Undang Nomor 10 tentang Perubahan Kedua atas Undang-Undang Nomor 1 Tahun 2015 tentang Penetapan Peraturan Pemerintah Pengganti Undang-Undang Nomor 1 Tahun 2014 tentang Pemilihan Gubernur, Bupati, dan Walikota Menjadi Undang-Undang.
Pasal 187A UU Nomor 10 Tahun 2016 mengatur bahwa setiap orang yang dengan sengaja melakukan perbuatan melawan hukum menjanjikan atau memberikan uang atau materi lainnya sebagai imbalan kepada warga negara Indonesia, baik secara langsung ataupun tidak langsung untuk mempengaruhi Pemilih akan dipidana dengan pidana penjara paling singkat 36 (tiga puluh enam) bulan dan paling lama 72 (tujuh puluh dua) bulan dan denda paling sedikit Rp200.000.000,00 (dua ratus juta rupiah) dan paling banyak Rp1.000.000.000,00 (satu milyar rupiah). Pidana yang sama juga diterapkan kepada pemilih yang dengan sengaja menerima pemberian atau janji tersebut.
Reaksi Masyarakat Bangka Barat
Putusan MK ini tentu saja menimbulkan reaksi beragam di masyarakat Bangka Barat. Ada yang mendukung putusan tersebut karena dianggap sebagai langkah penegakan hukum yang tegas. Namun, ada pula yang menyayangkan pembatalan hasil Pilkada karena dianggap merugikan proses demokrasi.
“Kami mendukung penuh putusan MK ini. Ini adalah bukti bahwa hukum di Indonesia masih tegak,” ujar Angga salah satu warga Bangka Barat
“Kami menyayangkan pembatalan hasil Pilkada ini. Ini adalah preseden buruk bagi demokrasi di Indonesia,” ujar warga lainnya.
Imbauan untuk Pilkada Serentak 2024
Dengan adanya kasus ini, diharapkan semua pihak dapat lebih berhati-hati dan tidak melakukan praktik politik uang dalam Pilkada Serentak 2024.
“Mari kita jaga kemurnian demokrasi dan pilih pemimpin yang berkualitas tanpa dipengaruhi oleh uang atau materi lainnya,”harap Bujang
Ketua KPU Babel Husen yang diwawancarai melalui sambungan telepon mengatakan hasil MK telah menyebutkan bahwa telah terjadi politik uang di empat TPS yang dilakukan olah Paslon, jadi bukan ramah KPU
“KPU bertugas menyelengarakan pemungutan suara dan itu berjalan lancar, walaupun ada PSU di 4 TPS di Desa Sekar Manik Kecamatan Jebus dikarenakan adanya kecurangan politik uang yang dilakukan oleh paslon, bukan kami sebagai penyelenggara,”ungkapnya
Husen juga mengaskan apa yang terjadi di Pilkada Bangka Barat itu ranahnya di Bawaslu atau Gakumdu, bukan di KPU, KPU siap melaksanakan amar putusan MK untuk PSU di 4 tps tersebut
“Kalau politik uang silahkan tanya Bawaslu atau Gakumdu ranahnya, kami KPU siap melaksanakan PSU di 4 TPS yang ditetapkan MK,” tutupnya.(Yuko)
