Jaksa Tuntut 3 Terdakwa Perkara LPEI dengan Pidana Penjara 6 Sampai Dengan 11 Tahun

JAKARTA, PERKARANEWS.COM — Pengadilan Tindak Pidana Korupsi (Tipikor) pada Pengadilan Negeri Jakarta Pusat kembali menggelar sidang perkara dugaan korupsi terkait pemberian fasilitas kredit oleh Lembaga Pembiayaan Ekspor Indonesia (LPEI) kepada PT Petro Energy, Selasa (17/11).

 

Agenda sidang kali ini adalah pembacaan tuntutan oleh Jaksa Penuntut Umum (JPU) Komisi Pemberantasan Korupsi (KPK) terhadap tiga terdakwa: Newin Nugroho, Susy Mira Dewi, dan Jimmy Masrin.

Dalam tuntutannya, JPU menyatakan bahwa unsur‐unsur objektif dan subjektif tindak pidana korupsi telah terpenuhi, dan ketiga terdakwa “secara sadar, meyakinkan, dan bersama-sama” melakukan korupsi secara berlanjut sebagaimana dakwaan Pasal 2 ayat (1) jo. Pasal 18 UU Tipikor.

 

Ketiga terdakwa dalam perkara ini ialah Newin Nugroho selaku Presiden Direktur PT Petro Energy, Susy Mira Dewi Sugiarta selaku Direktur PT Petro Energy, serta Jimmy Marsin selaku Komisaris Utama PT Petro Energy dan penerima manfaat PT Petro Energy.

 

“Menyatakan Terdakwa I Newin Nugroho, Terdakwa II Susy Mira Dewi Sugiarta, Terdakwa III Jimmy Marsin telah terbukti secara sah dan meyakinkan bersalah melakukan tindak pidana korupsi secara bersama-sama dan berlanjut sebagaimana diatur dan diancam pidana dalam Pasal 2 ayat 1 juncto Pasal 18 UU Tipikor juncto Pasal 55 ayat 1 ke-1 KUHP juncto Pasal 64 ayat 1 KUHP,” ujar jaksa

 

Berikut tuntutan terhadap para terdakwa:

– Newin dituntut 6 tahun penjara dan denda Rp 250 juta subsider 4 bulan kurungan.

– Susy dituntut 8 tahun 4 bulan penjara dan denda Rp 250 juta subsider 4 bulan kurungan.

– Jimmy dituntut 11 tahun penjara, denda Rp 400 juta subsider 6 bulan kurungan serta uang pengganti USD 32.691.551,88 subsider 5 tahun penjara.

 

Menangapi hal ini, Kuasa hukum Jimmy Masrin, Waldus Situmorang, mengkritik keras tuntutan JPU. Ia menilai narasi tuntutan mengandung kekeliruan mendasar terutama mengenai pemahaman konsep “pembayaran” dan “pengembalian”.

 

“Tuntutan ini di luar dugaan kami. Pembayaran kewajiban Petro kepada LPEI dipersepsikan sebagai tindakan korupsi, seolah-olah itu pengembalian. Padahal pembayaran dan pengembalian adalah dua konsep hukum yang berbeda,” ujar Waldus.

 

Ia menjelaskan bahwa pembayaran kredit Petro sudah berlangsung sejak 2022, jauh sebelum perkara ini disidik, sehingga tidak mungkin dikategorikan sebagai “pengembalian hasil kejahatan”.

 

Tentang pembayaran hutang, Waldus memaparkan bahwa Petro telah membayar, tidak pernah terlambat, bunga dibayar penuh dan masih ada sisa itu masih dibayarkan hingga 2028.

 

“Ini semua adalah hubungan perdata. Hutang kepada LPEI dibayar tepat waktu, lengkap dengan bunga. Mengapa dipaksa menjadi seolah-olah pengembalian kerugian negara?” tegasnya.

 

Waldus juga menanggapi tudingan bahwa Jimmy “berbelit-belit” dalam persidangan.

 

“Jimmy itu komisaris, jarang bicara. Peran terkait operasional ada pada direksi. Menyebutnya berbelit-belit hanya untuk mendalilkan tuntutan sebelas tahun adalah ketidaklogisan,” ujarnya.

 

Kuasa Hukum menegaskan bahwa seluruh aliran dana adalah bagian dari perjanjian kredit yang sah dan mengikat, sebagaimana Pasal 1320 dan 1338 KUHPerdata.

 

“Perjanjian itu adalah undang-undang bagi para pihak. Dan sampai hari ini tidak ada wanprestasi. Hukum pidana baru bisa masuk kalau ada ingkar janji, sementara pembayaran masih berjalan,” kata Waldus.

 

Pihaknya memastikan akan all-out dalam pembelaan, dengan fokus utama pada aspek keuangan dan fakta bahwa pembayaran dilakukan sesuai mekanisme perjanjian.

 

Sidang akan berlanjut ke agenda pembacaan pleidoi dari masing-masing terdakwa. Perkara ini menjadi sorotan karena menyangkut tata kelola pembiayaan ekspor serta perdebatan mengenai batas antara hubungan perdata kredit dan ketentuan pidana korupsi. (AR)
