JAKARTA, PERKARANEWS.COM – Sidang lanjutan kasus dugaan korupsi kredit di Lembaga Pembiayaan Ekspor Indonesia (LPEI) kembali digelar di Pengadilan Tipikor Jakarta Pusat, Senin (6/10/2025). Skandal yang menyeret nama besar perusahaan energi PT Petro Energy ini disebut jaksa berpotensi menimbulkan kerugian negara hingga Rp900 miliar, bahkan disebut bisa membengkak hingga Rp11,7 triliun.
Tiga terdakwa hadir dalam persidangan, yakni Jimmy Masrin (JM) selaku pemilik PT Petro Energy, Newin Nugroho (NN) sebagai Direktur Utama, dan Susy Mira Dewi (SMD) sebagai Direktur Keuangan. Sidang dipimpin oleh Hakim Ketua Brelly Yuniar Dien Wardi Haskori, S.H., M.H.
Dalam agenda pemeriksaan saksi, Dwi Wahyudi, mantan Kepala Divisi 2 Pembiayaan LPEI, memberikan keterangannya di hadapan majelis hakim. Namun, pernyataan saksi tersebut langsung ditanggapi tegas oleh penasihat hukum terdakwa Jimmy Masrin, Waldus Situmorang. Iya mengatakan, pemberian fasilitas pembiayaan kepada PT Petro Energy, sama sekali tidak menyalahi aturan hukum dan tidak menimbulkan kerugian negara.
“Semua proses sudah sesuai ketentuan dan tujuannya jelas untuk mendukung kegiatan ekspor nasional,” ujar Waldus.
Menurut Waldus, pembiayaan yang diberikan LPEI merupakan program penugasan pemerintah, sebagaimana diatur dalam Undang-Undang Nomor 2 Tahun 2009 tentang LPEI, khususnya Pasal 18. Ketentuan tersebut menyebut bahwa LPEI memiliki mandat untuk mendorong pertumbuhan sektor swasta demi memperkuat perekonomian nasional.
Namun ironisnya, lanjut Waldus, bunga kredit yang dikenakan kepada PT Petro Energy justru mencapai 10%, bunga ini lebih tinggi dari bunga bank umum, padahal pembiayaan tersebut bersifat penugasan dari pemerintah.
“Seharusnya sifat penugasan itu mendorong, bukan memberatkan. Apalagi pembiayaan dilakukan dalam bentuk dolar AS, sementara kurs terus naik terhadap rupiah. Beban pengembaliannya jadi sangat berat,” tegas Waldus.
Ia juga menegaskan bahwa dana pembiayaan dari LPEI telah digunakan untuk kegiatan yang benar-benar berkaitan dengan ekspor, baik langsung (direct export) maupun tidak langsung (indirect export) — seperti proyek infrastruktur dan energi yang mendukung kegiatan ekspor nasional.
“Seluruh dana dialokasikan sesuai tujuan pembiayaan. Tidak ada penyimpangan. Semua kegiatan mendukung ekspor nasional, baik langsung maupun tidak langsung,” jelasnya.
Lebih lanjut, Waldus mengungkap bahwa jaminan yang diberikan PT Petro Energy justru jauh melebihi nilai pinjaman yang diterima. Total nilai jaminan mencapai lebih dari Rp1 triliun, terdiri dari 21 objek jaminan berupa tanah, bangunan, dan piutang yang dijaminkan melalui fidusia.
“Jaminannya luar biasa besar, bahkan melebihi plafon kredit. Ada 21 jaminan, baik benda bergerak maupun tidak bergerak. Semuanya sah secara hukum dan diatur dalam Undang-Undang Fidusia,” terang Waldus.
Kuasa hukum Jimmy Masrin itu juga menyoroti tuduhan kerugian negara yang dinilainya tidak masuk akal. Menurutnya, mengacu pada Undang-Undang Nomor 1 Tahun 2004 tentang Perbendaharaan Negara, kerugian negara hanya terjadi jika ada pengurangan aset negara.
“Dalam kasus ini, tidak ada aset negara yang berkurang. Pembayaran bunga, penalti, dan cicilan tetap berjalan, bahkan saat perusahaan mengalami kesulitan keuangan,” tegasnya lagi.
Waldus menambahkan, selisih nilai tukar antara dolar dan rupiah justru menambah beban pembayaran hingga miliaran rupiah.
“Selisih kurs dolar ke rupiah saja bisa mencapai Rp7 miliar. Jadi di mana letak kerugian negara kalau pembayaran terus dilakukan dan jaminan melebihi nilai kredit?,” tandasnya.
Lebih lanjut Waldus menegaskan bahwa mekanisme pembiayaan yang dilakukan LPEI terhadap PT Petro Energy sepenuhnya sejalan dengan mandat lembaga tersebut, yaitu mendorong ekspor nasional melalui pembiayaan langsung maupun tidak langsung kepada sektor strategis.
“Kami ingin majelis hakim melihat fakta hukum secara objektif. Ini bukan korupsi, ini justru bentuk dukungan terhadap kebijakan ekspor nasional,” pungkas Waldus Situmorang. (Yuko)
