Iwan Henry Wardhana Dituntut 12 Tahun Penjara, Kuasa Hukum Nilai Tuntutan Tak Berdasar Fakta Persidangan

JAKARTA, PERKARANEWS.COM – Sidang lanjutan perkara dugaan tindak pidana korupsi di Dinas Kebudayaan Provinsi DKI Jakarta kembali digelar di Pengadilan Tindak Pidana Korupsi (Tipikor) pada Pengadilan Negeri Jakarta Pusat, Kamis (9/10/2025). Agenda persidangan kali ini adalah pembacaan tuntutan oleh Jaksa Penuntut Umum (JPU) terhadap terdakwa mantan Kepala Dinas Kebudayaan, Dr. Iwan Henry Wardhana, S.E., M.Sc.

 

Dalam tuntutannya, JPU menilai Iwan bersama dua terdakwa lain, Muhammad Fairza Maulana dan Gatot Arif Rahmadi, terbukti secara sah dan meyakinkan melakukan tindak pidana korupsi secara bersama-sama yang menyebabkan kerugian negara hingga Rp36 miliar dari sejumlah kegiatan yang tercatat dalam APBD DKI Jakarta tahun 2022–2024.

Atas dasar itu, Iwan dituntut 12 tahun penjara, denda Rp500 juta subsider 3 tahun kurungan, serta diwajibkan membayar uang pengganti sebesar Rp20 miliar, subsider 6 tahun kurungan.

 

“Para terdakwa terbukti dan meyakinkan melakukan tindak pidana korupsi secara bersama-sama,” tegas JPU dalam sidang yang dipimpin oleh Majelis Hakim Tipikor PN Jakarta Pusat.

Kuasa Hukum: Fakta Persidangan Tidak Menunjukkan Keterlibatan Iwan

 

Menanggapi tuntutan tersebut, penasihat hukum terdakwa, Ezar Ibrahim, S.H., menilai tuntutan jaksa tidak mencerminkan fakta sebenarnya yang terungkap di persidangan. Menurut Ezar, tidak ada bukti yang menunjukkan bahwa kliennya menerima uang atau ikut serta dalam pengaturan proyek di Dinas Kebudayaan DKI Jakarta.

 

“Kami sangat menyayangkan tuntutan ini. Dari seluruh proses pembuktian, tidak ada satu pun alat bukti yang menguatkan bahwa Pak Iwan menerima dana atau memerintahkan pencairan anggaran tersebut,” ujar Ezar Ibrahim kepada wartawan usai persidangan.

 

Ezar menjelaskan, dari hasil pemeriksaan dan fakta yang muncul di persidangan, sejumlah poin penting menunjukkan bahwa Iwan Henry Wardhana tidak terlibat langsung dalam praktik yang didakwakan.

Fakta Persidangan: Tandatangan Dipalsukan dan Rekening Dipinjam Tanpa Sepengetahuan Iwan

 

Dalam berkas perkara Nomor 56/Pid.Sus-TPK/2025/PN.Jkt.Pst, ditemukan beberapa fakta penting selama persidangan, di antaranya:

 

1. Tidak terbukti adanya penerimaan dana dari terdakwa Gatot Arif Rahmadi kepada Iwan Henry Wardhana. Tuduhan itu hanya bersumber dari satu saksi tanpa bukti pendukung lainnya.

 

 

2. Mark up kegiatan dan penggunaan sanggar fiktif dilakukan oleh Gatot Arif Rahmadi dan Muhammad Fairza Maulana tanpa sepengetahuan Iwan.

 

 

3. Tanda tangan Iwan Henry Wardhana dipalsukan, dengan menggunakan stempel atau hasil scan pada dokumen SPJ untuk pencairan anggaran. Hasil pemeriksaan ahli grafonomi membuktikan bahwa tanda tangan tersebut bukan milik asli Iwan.

 

 

4. Rekening milik sanggar, perusahaan, hingga pegawai dipinjam untuk keperluan pencairan dana Dinas Kebudayaan dan dikembalikan ke rekening terdakwa Gatot Arif Rahmadi, tanpa sepengetahuan Iwan.

 

 

5. Ditemukan adanya kerja sama antara Gatot Arif Rahmadi dan Fairza Maulana dalam mengubah jenis kegiatan “Festival Bongsang” tahun 2022 tanpa pemberitahuan kepada Iwan.

 

“Semua bukti di persidangan justru menunjukkan adanya rekayasa administratif dan manipulasi oleh pihak lain. Klien kami bahkan menjadi korban pemalsuan tanda tangan dan penyalahgunaan kewenangan bawahannya,” tegas Ezar.

 

Ia menambahkan, pihaknya berharap majelis hakim dapat mempertimbangkan fakta-fakta tersebut secara objektif dan adil dalam putusan mendatang.

 

“Kami percaya majelis hakim akan menilai berdasarkan fakta hukum, bukan asumsi. Tuntutan ini sangat tidak proporsional dan tidak sesuai dengan peran Pak Iwan dalam struktur birokrasi saat itu,” tutup Ezar. (Yuko)
