BANGKA BARAT,PERKARANEWS.COM- Konflik agraria di Kelurahan Kelapa, Kecamatan Kelapa, Kabupaten Bangka Barat, kian memanas. Para petani yang tergabung dalam masyarakat Landbow, didampingi tim hukum dari LBH Milenial Bangka Tengah Keadilan, kembali mendatangi Kantor Lurah Kelapa pada Selasa (29/7).
Kedatangan mereka kali ini bukan tanpa alasan, melainkan untuk menagih janji dan kepastian hukum terkait sengketa lahan seluas 113 hektar yang telah dimenangkan di Pengadilan Tata Usaha Negara (PTUN) Pangkalpinang.
Kuasa hukum petani Landbow, Rudi Sitompul dari LBH Milenial Bangka Tengah, menegaskan bahwa putusan PTUN Pangkalpinang dengan Nomor 16/G/PTUN.PGP tanggal 20 Maret 2025 telah mengabulkan gugatan para petani secara keseluruhan. Putusan ini secara jelas menyatakan tidak sahnya Surat Pernyataan Aset Nomor 560/220.4.1.3.1/2017 atas bidang tanah seluas kurang lebih 1.130.000 meter persegi (113 hektar) yang terletak di Jalan Raya Pangkalpinang – Mentok, Kelurahan Kelapa, Kecamatan Kelapa, Kabupaten Bangka Barat.
Tidak hanya itu, putusan pengadilan juga secara tegas mewajibkan tergugat untuk mencabut surat pernyataan aset tersebut. Ini berarti, secara hukum, hak atas lahan tersebut seharusnya kembali kepada masyarakat petani Landbow. Namun, realita di lapangan berkata lain.
Di hadapan Lurah Kelapa, Filkana Lirfitri Attal, Rudi Sitompul meluapkan kekecewaannya. “Kita sudah menang di PTUN, hak-hak masyarakat harusnya dikembalikan. Kenapa ini terkesan dipersulit? Kami ingin ada solusi konkret, bukan hanya janji-janji kosong. Banyak anak istri yang menggantungkan hidupnya dari lahan ini,” tegas Rudi dengan nada tinggi, menyoroti lambatnya proses pengembalian hak yang seharusnya sudah menjadi milik masyarakat.
Mendengar desakan tersebut, Lurah Kelapa Filkana Lirfitri Attal tampak serba salah. Ia mengaku hanya bawahan yang menjalankan perintah atasan. “Saya tidak bisa mengeluarkan surat apa pun terkait lahan Landbow ini. Atasan saya sudah memerintahkan untuk tidak menerbitkan atau mengeluarkan surat apa-apa terkait lahan yang disengketakan tersebut,” jelas Lurah, menunjukkan betapa rumitnya birokrasi yang harus dihadapi para petani.
Pernyataan Lurah ini sontak menimbulkan pertanyaan besar. Siapa “atasan” yang dimaksud yang seolah-olah menghalangi pelaksanaan putusan pengadilan? Diduga kuat, hambatan ini berkaitan dengan kepemimpinan sebelumnya dan saat ini di Bangka Barat.
“Padahal para petani di Desa Landbow sudah mendapatkan surat dari PTUN untuk mengembalikan hak-hak masyarakat. Tapi sepertinya harapan tersebut masih terhalang karena Bupati Bangka Barat saat itu dan sekarang dijabat oleh Markus,” tambah sumber yang enggan disebutkan namanya, mengindikasikan adanya campur tangan politik dalam penanganan sengketa lahan ini.
Para petani dan LBH Milenial Bangka Tengah Keadilan kini berharap agar pihak-pihak terkait, khususnya Pemerintah Kabupaten Bangka Barat, segera menindaklanjuti putusan PTUN dan mengembalikan hak-hak masyarakat Landbow sepenuhnya.
