Terbukti Terima Suap, Arif Nuryanta dan Wahyu Gunawan Dijatuhi Vonis Belasan Tahun Penjara

JAKARTA, PERKARANEWS.COM — Pengadilan Tindak Pidana Korupsi (Tipikor) Jakarta Pusat, Rabu (3/12/2025) menjatuhkan putusan terhadap dua terdakwa dalam perkara korupsi suap terkait vonis bebas (onstlag) ekspor Crude Palm Oil (CPO) dan turunannya pada periode Januari–April 2022. Kedua terdakwa adalah Muhammad Arif Nuryanta, mantan Wakil Ketua Pengadilan Negeri Jakarta Pusat, dan Wahyu Gunawan, panitera.

 

Sidang dipimpin oleh Ketua Majelis Hakim Effendi, SH., MH., dengan agenda pembacaan putusan. Dalam amar putusannya, majelis hakim menjatuhkan vonis lebih rendah dari tuntutan jaksa, tetapi tetap menyatakan keduanya terbukti menerima suap secara bersama-sama.

Majelis hakim terlebih dahulu menyampaikan bahwa Arif dibebaskan dari dakwaan kesatu primer, namun dinyatakan terbukti bersalah pada dakwaan kesatu subsider terkait penerimaan suap.

 

“Majelis berpendapat bahwa unsur-unsur dalam dakwaan primer tidak terpenuhi. Namun dalam dakwaan subsider, terdakwa terbukti secara sah dan meyakinkan menerima suap yang dilakukan secara bersama-sama.” tegas hakim.

 

Dalam putusannya, majelis menjatuhkan pidana Muhammad Arief Nuryanta dengan penjara 12 tahun 6 bulan, denda sebesar Rp500 juta, subsider 6 bulan kurungan, serta membayar uang Pengganti Rp14.734.276.000,-

 

Hakim menegaskan bahwa pembayaran uang pengganti wajib dilakukan maksimal satu bulan setelah putusan berkekuatan hukum tetap.

 

“Apabila terdakwa tidak membayar uang pengganti dalam batas waktu tersebut, maka jaksa berwenang menyita dan melelang harta bendanya. Jika harta tidak mencukupi, terdakwa wajib menjalani pidana penjara selama empat tahun,” tegas Hakim Effendi dalam sidang.

 

Dilanjutkan untuk terdakwa Wahyu Gunawan, majelis hakim menyatakan bahwa seluruh unsur dakwaan alternatif kedua terpenuhi.

 

“Terdakwa Wahyu Gunawan terbukti secara sah dan meyakinkan ikut serta menerima suap bersama-sama sebagaimana dakwaan alternatif kedua,” ujar Hakim Effendi.

 

Wahyu Gunawan dijatuhi vonis penjara selama 11 tahun 6 bulan, denda sebesar Rp500 juta, subsider 6 bulan kurungan, serta membayar uang Pengganti sebesar Rp2.365.300.000,-.

 

 

Hakim kembali menegaskan konsekuensi bila uang pengganti tidak dibayar.

 

“Apabila dalam satu bulan setelah putusan inkracht uang pengganti tidak dibayarkan, maka jaksa dapat menyita harta terdakwa. Jika harta tidak mencukupi, terdakwa harus menjalani pidana penjara empat tahun,” ucap hakim.

 

Vonis yang dijatuhkan majelis hakim lebih rendah dari tuntutan jaksa penuntut umum (JPU). Dalam agenda sidang tuntutan JPU,  Muhammad Arif Nuryanta dituntut 15 tahun, denda Rp500 juta, uang pengganti Rp15,7 miliar 12,5 tahun, denda Rp500 juta, uang pengganti Rp14,7 miliar, sementara Wahyu Gunawan 12 tahun, denda Rp500 juta, uang pengganti Rp2,4 miliar 11,5 tahun, denda Rp500 juta, uang pengganti Rp2,36 miliar

 

Perkara ini bermula dari dugaan penerimaan suap oleh hakim dan panitera terkait putusan bebas ekspor CPO pada 2022. Para terdakwa dinyatakan melanggar ketentuan, Pasal 12 huruf c, Pasal 12B, Pasal 6 ayat (2) jo Pasal 18 UU Tipikor, jo Pasal 55 ayat (1) ke-1 KUHP. (AR)
