Kasus Kredit Macet BNI: Tiga Terdakwa Dituntut 4 hingga 6 Tahun Penjara

JAKARTA, PERKARANEWS.COM — Sidang perkara dugaan tindak pidana korupsi penyaluran kredit macet di Bank Negara Indonesia (BNI) kembali digelar di Pengadilan Tindak Pidana Korupsi (Tipikor) Jakarta Pusat, Senin (8/12/2025). Agenda sidang kali ini adalah pembacaan tuntutan dari Jaksa Penuntut Umum (JPU) terhadap tiga terdakwa yang disebut menyebabkan kerugian negara sebesar Rp34,51 miliar.

 

Empat terdakwa dalam perkara ini adalah Lia Hertika Hudayani, Ferry Syarfariko, Nazal Gilang Ramadhan, serta Lilys Yuliana alias Sansan yang saat ini berstatus DPO. Para terdakwa didakwa telah melanggar Pasal 2 ayat (1) jo. Pasal 18 UU Tipikor, juncto Pasal 55 ayat (1) ke-1 KUHP serta Pasal 64 ayat (1) KUHP, dan secara subsider dijerat Pasal 3 UU Tipikor.

Dalam tuntutannya, JPU meminta majelis hakim menjatuhkan pidana:

 

Lia Hertika Hudayani: 6 tahun penjara, denda Rp200 juta subsider 6 bulan, serta uang pengganti Rp2,8 miliar subsider 1 tahun.

Ferry Syarfariko: 6 tahun penjara, denda Rp200 juta subsider 6 bulan.

Nazal Gilang Ramadhan: 4 tahun penjara, denda Rp200 juta subsider 6 bulan.

 

Penasihat hukum terdakwa Lia, Erdi Surbakti, menyampaikan keberatan keras atas tuntutan jaksa yang dinilainya tidak berdasar dan tidak sejalan dengan fakta persidangan. Erdi menilai tuntutan 6 tahun penjara terhadap kliennya sangat janggal dan tidak mencerminkan fakta persidangan.

 

“Tuntutan 6 tahun itu di luar ekspektasi kami, terutama apa yang menjadi fakta-fakta persidangan.” ujarnya.

 

Menurutnya, keterangan para saksi justru menunjukkan adanya persoalan administrasi dan sistem manajerial di internal BNI, bukan perbuatan melawan hukum yang dilakukan oleh Lia.

 

“Dari keseluruhan saksi itu, ada memang persoalan banyak akibat administrasi, oleh karena ada sistem-sistem yang dianut BNI secara manajerial.” terangnya.

 

Erdi juga mempertanyakan keabsahan klaim kerugian negara yang disebutkan JPU, sebab audit internal yang dijadikan dasar tidak dapat memberikan gambaran perhitungan yang lengkap.

 

“Selama persidangan, kerugian negara yang dimaksud dakwaan itu belum bisa dibuktikan secara utuh oleh keterangan saksi dan ahli audit.” terangnya.

 

Ia menegaskan kredit yang diberikan justru berjalan lancar pada tahun pertama.

 

“Kredit tahun pertama itu lancar. Artinya, kerugian negara sebagaimana dakwaan masih perlu diperdebatkan.” jelasnya.

 

Erdi juga menyebut JPU seolah membebankan seluruh kerugian kepada Lia, padahal secara struktur banyak pihak lain yang turut memproses kredit.

 

“Semuanya dibebankan kepada dia (Lia-red), ini kita menuntut sesuatu yang jauh dari kebenaran material.” sebutnya.

 

Ia bahkan menyinggung pejabat lain seperti penyelia, Wapinca, hingga tim pemeriksa TKP/OTS yang juga memiliki kewenangan.

 

“Kalau di Jakarta Kota dibebankan pada GRM, apa fungsinya penyelia di sana? Di sana sudah kelihatan Wapinca bertanggung jawab.” ungkapnya.

 

Lebih lanjut Erdi mengatakan, tim kuasa hukum menilai audit internal yang digunakan jaksa tidak memenuhi kaidah audit profesional.

 

“Kalau kita memulai dengan satu audit, apalagi sampel yang dipakai juga dalam persidangan tidak bisa disetujui.” jelas Erdi.

 

Menanggapi tuntutan JPU, Erdi memastikan pihaknya akan menyusun pledoi yang menyoroti siapa pihak yang sesungguhnya bertanggung jawab dalam setiap tahapan kredit.

 

“Kami akan menguraikan kebenaran material, siapa berbuat apa itu harus diuraikan.” tandasnya.

 

Termasuk mengenai angka kerugian Rp34,51 miliar yang disebut jaksa dibebankan sepenuhnya kepada Lia.

 

“Apa semua dibebankan ke Lia sesuai dengan 34 miliar itu? Nah, itu yang akan kita uraikan dalam pledoi.” pungkasnya. (AR)
