Presiden Prabowo Terbitkan Rehabilitasi untuk Eks Dirut ASDP Ira Puspadewi: Ini Penjelasan Hukum di Baliknya

JAKARTA, PERKARANEWS.COM – Presiden Prabowo Subianto resmi menerbitkan keputusan rehabilitasi bagi mantan Direktur Utama PT ASDP Indonesia Ferry, Ira Puspadewi, yang sebelumnya dijatuhi pidana penjara 4 tahun 6 bulan oleh pengadilan. Kebijakan serupa juga diberikan kepada dua mantan pejabat ASDP lainnya, yakni Muhammad Yusuf Hadi (Direktur Komersial) dan Harry Muhammad Adhi Caksono (Direktur Perencanaan dan Pengembangan).

 

Keputusan presiden tersebut disahkan pada Selasa (25/11/2025) sore. Wakil Ketua DPR RI, Sufmi Dasco Ahmad, mengumumkan secara resmi langkah ini dalam konferensi pers di Istana Kepresidenan.

“Alhamdulillah, hari ini Presiden Republik Indonesia Bapak Prabowo Subianto telah menandatangani surat rehabilitasi terhadap tiga nama tersebut,” ujar Dasco.

 

Dasco menjelaskan bahwa proses pemberian rehabilitasi berawal dari banyaknya aspirasi masyarakat yang masuk ke DPR terkait perkara yang menjerat Ira Puspadewi dan dua rekannya. Menindaklanjuti hal itu, DPR menugaskan Komisi III untuk melakukan kajian hukum mendalam atas putusan dan proses peradilan yang telah berlangsung.

 

“Kami menerima aspirasi dari berbagai kelompok masyarakat. Komisi Hukum kemudian melakukan kajian atas perkara tersebut,” kata Dasco.

 

“Hasil kajian itu kemudian kami sampaikan kepada pemerintah sebagai bahan pertimbangan,” lanjutnya.

 

Secara konstitusional, kewenangan Presiden untuk memberikan rehabilitasi sejalan dengan Pasal 14 Undang-Undang Dasar 1945, yaitu:

1. Presiden memberi grasi dan rehabilitasi dengan memperhatikan pertimbangan Mahkamah Agung (MA).

2. Presiden memberi amnesti dan abolisi dengan memperhatikan pertimbangan Dewan Perwakilan Rakyat (DPR).

 

Di dalam ranah hukum acara, Pasal 1 angka 23 Kitab Undang-Undang Hukum Acara Pidana (KUHAP) mendefinisikan rehabilitasi sebagai pemulihan hak seseorang atas kemampuan, kedudukan, serta harkat dan martabatnya — yang diberikan apabila seseorang ditangkap, ditahan, dituntut, atau diadili tanpa dasar hukum yang sah, atau karena kekeliruan penerapan hukum maupun kekeliruan orang.

 

Penjelasan Umum KUHAP juga menegaskan bahwa rehabilitasi dapat diberikan sejak tahap penyidikan apabila ditemukan bahwa tindakan aparat penegak hukum dilakukan tanpa alasan yang sah atau terjadi kekeliruan yang menimbulkan kerugian bagi individu yang diperiksa.

 

Lebih jauh, aparat yang bertindak keliru sehingga merugikan hak seseorang dapat dimintai pertanggungjawaban, baik pidana maupun administratif.

 

Setelah amandemen UUD 1945, kewenangan presiden dalam memberikan grasi, rehabilitasi, amnesti, dan abolisi tidak lagi berdiri sendiri. Presiden wajib memperhatikan pertimbangan lembaga yudikatif (MA) maupun legislatif (DPR). Mekanisme ini dipertahankan guna memperkuat fungsi checks and balances dalam sistem ketatanegaraan, serta memastikan keputusan presiden tetap berada dalam koridor akuntabilitas publik. (AR)
