JAKARTA, PERKARANEWS.COM — Sidang perdana perkara perintangan penyidikan, penuntutan, dan sidang pengadilan dalam kasus dugaan korupsi tata niaga komoditas timah yang merugikan keuangan negara hingga Rp 271 T, digelar di Pengadilan Tipikor Jakarta Pusat, Rabu (23/10) malam.
Enam terdakwa dihadirkan dalam ruang sidang yang dipimpin oleh Majelis Hakim Efendi, yakni:
– Marcella Santoso (advokat)
– Junaedi Saibih (advokat/dosen)
– Tian Bahtiar (Direktur JakTV)
– M. Adhiya Muzzaki (aktivis/ketua buzzer)
– Ariyanto Bakri (advokat)
– M. Syafei
Dalam pembacaan surat dakwaan, Jaksa Penuntut Umum (JPU) dari Kejaksaan Agung membeberkan bahwa para terdakwa diduga berupaya menghalangi dan menggagalkan proses hukum perkara korupsi timah melalui berbagai cara yang sistematis dan terencana.
Strategi Perintangan: Narasi Negatif, Tekanan Publik, dan Pelaporan Ahli
Menurut JPU, bentuk perintangan itu antara lain berupa pembuatan narasi dan opini negatif terhadap proses penanganan perkara. Narasi tersebut disebarkan lewat media massa, media sosial, seminar, demonstrasi, hingga pelaporan polisi terhadap saksi ahli Kejaksaan.
“Para terdakwa secara bersama-sama menggunakan peran buzzer, akademisi, media, organisasi kemasyarakatan, dan LSM untuk menggiring opini publik bahwa perhitungan kerugian negara dalam perkara timah tidak benar,” ujar JPU dalam sidang.
Salah satu sasaran mereka adalah Prof. Bambang Hero, ahli yang dihadirkan oleh Kejaksaan dalam pembuktian perkara. Ia disebut mengalami tekanan psikis akibat upaya sistematis yang diarahkan kepadanya.
Empat Nama dari Bangka Belitung yang turut Diseret
Dalam dakwaan tersebut, JPU juga menyebut empat nama dari Bangka Belitung (Babel) yang turut berperan dalam jejaring perintangan hukum ini, yakni:
– Nico Alpiandi (wartawan)
– Adam Marcos (disebut sebagai kaki tangan RBT)
– Elly Gustina Rebuin (aktivis)
– Andi Kusuma (lawyer)
“Marcella Santoso dan Junaedi Saibih meminta Adam Marcos, Nico Alpiandi, dan Elly Gustina Rebuin untuk membuat berita-berita negatif tentang perhitungan kerugian negara terkait perkara timah, serta menggerakkan massa untuk melakukan demonstrasi di kantor BPKP Babel,” tutur JPU membacakan dakwaan.
Selain itu, Marcella Santoso disebut memerintahkan Andi Kusuma untuk melaporkan Prof. Bambang Hero ke Polda Babel, dengan tudingan bahwa perhitungan kerugian negara sebesar Rp 271 triliun tidak benar.
“Tindakan itu mengakibatkan tekanan psikis kepada ahli atas pelaporan tersebut,” lanjut JPU.
Upaya Memengaruhi Penegakan Hukum
Jaksa menilai seluruh tindakan para terdakwa memiliki tujuan tunggal — mempengaruhi proses penanganan perkara, baik pada tahap penyidikan, penuntutan, maupun pemeriksaan di persidangan.
Perkara ini merupakan turunan dari kasus utama korupsi tata niaga timah di wilayah IUP PT Timah Tbk, yang sebelumnya menjerat sejumlah pejabat, pengusaha, dan pihak swasta.
Sidang akan kembali dilanjutkan pekan depan dengan agenda tanggapan dari para terdakwa dan tim penasihat hukum terhadap dakwaan JPU. (Yuko)
