Dugaan Korupsi di Dinas Kebudayaan DKI Jakarta, Eks Kadis dan Plt Kabid Ditahan Kejati DKI Jakarta

JAKARTA,PERKARANEWS – Jaksa Penuntut Umum (JPU) menanggapi eksepsi atas terdakwa mantan Kepala Dinas Kebudayaan DKI Jakarta, Iwan Henry Wardhana bersama dua orang lainnya, yaitu eks Kabid Pemanfaatan M Fairza Maulana dan pihak swasta berinisial Gatot Arif Rahmadi pemilik Even Organizer (EO) Booth Produksi (GR PRO).

JPU menyebut surat dakwaan yang disampaikan pada agenda sidang dakwaan, telah sesuai dengan ketentuan undang-undang yang berlaku dan dapat dijadikan dasar dalam pemeriksaan perkara pengadaan sanggar-sanggar fiktif dalam pembuatan surat pertanggungjawaban (SPJ), yang diduga untuk pencairan dana kegiatan pagelaran seni dan budaya.

Sehingga mengakibatkan kerugian negara lebih dari Rp150 miliar berdasarkan nilai kegiatan dalam dokumen anggaran APBD Tahun 2023.

“Pemeriksaan atas terdakwa Iwan Hendry Wardhana, M Fairza Maulana dan Gatot Arif Rahmadi tetap dilanjutkan, karena telah sesuai dengan ketentuan undang-undang yang berlaku dan dapat dijadikan dasar dalam pemeriksaan perkara,” tegas JPU di Pengadilan Tipikor, Jakarta Pusat, Selasa (1/7/2025).

Lebih lanjut JPU juga menyatakan keberatan atas eksepsi yang disampaikan Kuasa Hukum para Terdakwa.
“Alasan keberatan yang disampaikan dalam eksepsi para terdakwa sangat tidak beralasan,” tambah JPU.

Perkara ini teregister dengan nomor perkara 56/Pid.Sus-TPK/2025/PN Jkt.Pst. Perbuatan Terdakwa telah bertentangan dengan UU No. 28 Tahun 1999 tentang Penyelenggaraan Negara yang Bersih dan Bebas dari Korupsi, Kolusi dan Nepotisme, Peraturan Presiden RI No.12 Tahun 2021 tentang Pengadaan Barang/Jasa Pemerintah. Pengadaan kegiatan fiktif itu juga melanggar Peraturan Daerah Provinsi DKI Jakarta Nomor 5 Tahun 2007 tentang Pokok-Pokok Pengelolaan Keuangan Daerah, Peraturan Lembaga Kebijakan Pengadaan Barang/Jasa Pemerintah Nomor 8 Tahun 2018 tentang Pedoman Swakelola.

Diketahui dalam dakwaan JPU ketiga terdakwa telah melanggar Pasal 2 ayat (1), Pasal 3, Jo. Pasal 18 ayat (1) UU Nomor 20 Tahun 2001 tentang Perubahan Atas Undang-Undang Republik Indonesia Nomor 31 Tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi Jo. Pasal 55 ayat (1) ke-1 KUHP Jo.
