Dr. Prija Jatmika: Diferensiasi Fungsional Kewenangan yang Berbeda Antara Kepolisian dan Kejaksaan

JAKARTA,PERKARANEWS.COM– Pakar Hukum Pidana dan Kriminolog Universitas Brawijaya (UB), Dr Prija Jatmika menyinggung, diferensiasi fungsional menyangkut kewenangan yang berbeda antara Kepolisian dan Kejaksaan.

Pernyataan itu menyusul keluarnya Rancangan Undang-Undang (RUU) Kitab Undang-Undang Hukum Acara Pidana (KUHAP) yang akan dibahas DPR RI pada 2025 ini. Dia melihat, terdapat sejumlah pasal yang dapat menimbulkan persoalan kedepan bagi dua institusi tersebut.

Pasal-pasal yang disorotinya, diantaranya pada pasal 111 ayat 2, pasal 12 ayat 11, Pasal 6 hingga Pasal 30b. Sejumlah pasal tersebut berpotensi dapat menimbulkan persoalan dalam penegakan dan kepastian hukum ke depan.

Dalam pasal 111 ayat 2, memberikan kewenangan jaksa untuk mempertanyakan sah atau tidaknya penangkapan dan penahanan yang dilakukan kepolisian.

“Seharusnya pasal tersebut mutlak jadi kewenangan kepolisian. Apabila hal ini tetap diterapkan maka dikhawatirkan akan menimbulkan penanganan perkara hukum yang tidak terpadu,” paparnya.

Pasal berikutnya, yakni Pasal 12 ayat 11 RUU KUHAP, menjelaskan bahwa apabila masyarakat melapor polisi tetapi dalam waktu 14 hari tidak ditanggapi, maka masyarakat bisa melaporkan ke kejaksaan.

“Dalam pasal itu, masyarakat ketika lapor polisi tidak ditangani, bisa langsung lapor ke JPU, lalu jaksa menegur polisi. Kalau 14 hari tidak ditindaklanjuti, jaksa boleh memeriksa sendiri dan menuntut sendiri. Jadi saya melihat sistem ini tidak jelas,” paparnya.

Selanjutnya, di Pasal 12 angka 11, menyebutkan jaksa boleh menerima laporan apapun dari masyarakat.

“Jika ini benar-benar diterapkan, nanti malah jadi kacau balau sistem penyidikan. Ini berpotensi tidak bisa menjamin kepastian hukum. Muaranya bisa-bisa terjadi penyalahgunaan wewenang,” imbuhnya.

Pasal yang mengerikan dan berpotensi menjadi masalah adalah tentang kewenangan penyadapan pada Pasal 30B. Perluasan kewenangan kejaksaan dalam bidang intelijen, termasuk hak untuk melakukan penyadapan dan menimbulkan kekhawatiran baru.

Dr Prija Jatmika melihat, hadirnya pasal-pasal tersebut merupakan suatu kemunduran, yang sebelumnya digunakan saat era Hindia Belanda hingga Orde Baru, pasal tersebut sudah pernah diterapkan dan kemudian dihapus dalam KUHAP.

“Ini memberi peluang jaksa untuk kembali sebagai penyidik, ini merusak tatanan distribusi kewenangan yang sudah diatur bagus dalam KUHAP, jadi ini langkah mundur. Seharusnya seperti saat ini jaksa hanya bisa menyidik pelanggaran HAM berat dan tindak pidana korupsi,” kata Dosen Fakultas Hukum UB itu.

Menurutnya, jaksa tidak berhak untuk menerima laporan masyarakat, kemudian melakukan pemeriksaan dan penuntutannya secara mandiri. Sebab, kewenangan sebagai jaksa itu tak seluruhnya mutlak menjadi penyidik.

“Ini akan terjadi tumpang tindih kewenangan dengan kepolisian. Kecuali, perkara tindak pidana khusus karena tindak pidana korupsi dan pelanggaran HAM berat itu extraordinary crime, kejahatan luar biasa,” ungkapnya.

Dibanding menerapkan pasal itu, menurutnya lebih baik merealisasikan penerapan jaksa wilayah. Yakni menempatkan jaksa berkantor di kantor kepolisian. Hal ini seperti yang ada di KPK yakni adanya penyidik kepolisian dan jaksa penuntut umum bekerja satu atap.

Ini juga sebagai efektivitas kinerja penanganan suatu perkara hukum, sehingga diharapkan dapat meminimalisasi terjadinya pengembalian berkas perkara yang bolak balik dari polisi ke jaksa.

“Pada saat penyidikan, tetap tugasnya polisi, jaksa bukan koordinasi saja tapi sinergi dalam rangka collecting evidence, atau pengumpulan barang bukti, jaksa dilibatkan setelah penyidikan,” jelasnya.

Lebih lanjut, dia juga menyoroti RUU KUHAP yang menyebutkan bahwa pelaksanaan restorative justice hanya bisa dilakukan oleh JPU. Menurut Dr Prija Jatmika, hal tersebut sangat bertentangan dengan asas adil, cepat dan murah.

“Palang pintu penyidikan itu di kepolisian. Maka dari itu, restorative justice dalam RUU KUHAP seharusnya diatur di tingkat penyidikan saja,” ujarnya.

Jika penerapan restorative justice dilaksanakan di JPU, maka bertentangan dan tidak sesuai dengan asas adil, cepat dan biaya murah. Padahal restorative justice ini bertujuan menemukan jalan terbaik antara korban dan pelaku. Konsep keadilan restoratif menekankan pemulihan kembali hak korban ke keadaan semula, bukan pembalasan.

“Kalau di JPU maka bukan restorative justice. Karena restorative justice itu harus dilakukan secepatnya. Kalau menunggu di JPU, maka harus menunggu pemberkasan di penyidik dulu,” ujarnya.

Pihaknya khawatir, apabila RUU KUHAP ini disahkan tanpa ada revisi, maka akan menimbulkan abuse of power atau tindakan penyalahgunaan wewenang yang dilakukan seorang untuk kepentingan tertentu, baik untuk kepentingan diri sendiri, orang lain atau korporasi.

“Nanti polisi menyidik, jaksa menyidik, maka masyarakat akan bingung, penyidikan jadi kewenangan siapa. Padahal aturan di seluruh dunia sudah jelas, penuntut dilakukan jaksa, kalau penyidik polisi,” katanya.

Dia juga menyampaikan, dalam RUU KUHAP, ketika jaksa diberi kewenangan memeriksa, menuntut, melakukan penyidikan dan penetapan hukum atas kasus ideologi, keamanan dan sosial budaya, bukan lagi tanahnya pidsus namun ranahnya pidum.

“Ini tidak menjamin kepastian hukum dan bisa jadi konflik interest antara kepolisian dan kejaksaan tentang prestasi. Padahal kepolisian tidak bisa menuntut, sedangkan kejaksaan bisa. Nanti dikhawatirkan perkara dari polisi tidak diloloskan sedangkan perkara dari penuntut umum selalu dipercepat,” tutupnya.(Yuko/Rils)
