PANGKALPINANG,PERKARANEWS-Galian kabel listrik PLN di kelurahan pasir garam menimbulkan keluhan bagi warga Rt.02 Rt.03/ Rw.02 karena galian kabel tersebut merusak fasilitas Umum(fasum) warga.
Saat di temui Tim media ketua Rt.02 dan Rt.03 sabtu 15/12/2024, sangat menyanyangkan galian kabel PLN yang melintasi jl.Tiram Raya sepanjang lebih kurang 250 m merusak selokan di sepanjang jalan.
“Cem mane orang gawe galian kabel ni sekenek bai ngerusak bandar la dak izin, di tinggal nak tu bai” ujar ketua Rt.02
Lain lagi saat Tim media saat bertemu ketua Rt.03/Rw.02 , melihat kondisi galian kabel PLN yang merusak fasilitas Umum berupa selokan di wilayah beliau.
“Ini pasti kerjaan kontraktor PLN yang serampangan, warga saya komplent akibat galian membuat banjir pada saat hujan, mengingat saat ini sudah memasuki musim penghujan kalau tidak cepat di perbaiki bekas galian Kabel PLN akan membuat semakin parah Banjir di wilayah kami”ujar ketua Rt.03
Selokan sepanjang kurang lebih 250 m di jalan Tiram Raya di bangun pada saat walikota Irwansyah dengan menelan dana 200 juta sengingngat saya selama ini kami selalu merawatnya karena sangat penting. Disitulah air buangan bagi limbah rumah tangga warga kami” ujar ketua Rt.03
Pasal dalam KUHP yang mengatur tentang perusakan fasilitas umum adalah Pasal 406 ayat (1) yang menyatakan bahwa orang yang merusak properti orang lain dipidana penjara maksimal dua tahun delapan bulan.
Selain itu, ada beberapa pasal lain yang berkaitan dengan perusakan fasilitas umum, yaitu:
Pasal 28 ayat 2 UU Nomor 22 Tahun 2009 mengatur tentang perusakan sarana kelengkapan jalan, seperti rambu lalu lintas, marka jalan, dan alat pemberi isyarat lalu lintas (APILL). Pelaku dapat dipidana penjara paling lama 2 tahun atau denda paling banyak Rp50.000.000.
Pasal 274 ayat 1 UU Nomor 22 Tahun 2009 mengatur tentang perusakan jalan yang mengakibatkan gangguan fungsi jalan. Pelaku dapat dipidana penjara paling lama 1 tahun atau denda paling banyak Rp24 juta.
Pasal 275 ayat 1 jo pasal 28 ayat 2 UU Nomor 22 Tahun 2009 mengatur tentang perusakan fasilitas pejalan kaki yang mengakibatkan gangguan fungsi.
Pelaku dapat dipidana kurungan paling lama 1 bulan atau denda paling banyak Rp250 ribu.
Perusakan fasilitas umum merupakan pelanggaran hak dan pengingkaran kewajiban bagi warga negara.(Yuko)
