BANGKA,PERKARANEWS-Seorang wiraswasta asal Bangka bernama Hamalik harus merasakan dinginnya penjara selama 1 tahun setelah menggadaikan mobil yang masih dalam masa kredit.

Ketika ACC melakukan kunjungan ke rumah Hamalik ternyata kendaraan sudah dikuasai oleh anaknya. Setelah dilakukan pengecekan, anak Hamalik berdalih kendaraan sedang dipinjam oleh rekan kerjanya padahal mobil telah dialihkan ke pihak ketiga.
Merasa dirugikan ratusan juta rupiah, ACC Pangkal Pinang membuat laporan polisi di Kepolisian Resor Kota (Polresta) Pangkal Pinang. Pada 16 Oktober 2023 Hamalik ditetapkan sebagai tersangka dan berkas perkara diserahkan ke Kejaksaan Negeri Pangkal Pinang. ACC Pangkal Pinang juga melaporkan anak Hamalik dan penadah kendaraan dan keduanya telah ditetapkan sebagai tersangka.
Pada 6 Agustus 2024 Majelis Hakim memutuskan bahwa Hamalik terbukti secara sah dan meyakinkan bersalah melakukan tindak pidana menyuruh melakukan mengalihkan objek fidusia tanpa persetujuan tertulis dari penerima fidusia dan menjatuhkan pidana penjara selama 1 tahun beserta denda sebesar 10 juta rupiah, dengan ketentuan apabila denda tersebut tidak dibayar maka diganti dengan pidana selama 2 bulan.
Branch Manager ACC Pangkal Pinang Ramiaji angkat bicara mengenai kasus Hamalik tersebut dengan mengatakan bahwa pada dasarnya tindakan menggadaikan kendaraan yang masih dalam masa kredit adalah tindakan yang melanggar hukum.
“Menggadaikan kendaraan cicilan merupakan perbuatan melanggar hukum yaitu pelanggaran sanksi pidana UU Jaminan Fidusia, sesuai dalam Pasal 36 UU No. 42 Tahun 1999 tentang Jaminan Fidusia. Pasal tersebut menyatakan bahwa pemberi fidusia yang mengalihkan, menggadaikan, atau menyewakan Benda yang menjadi objek Jaminan Fidusia sebagaimana dimaksud dalam Pasal 23 ayat (2) yang dilakukan tanpa persetujuan tertulis terlebih dahulu dari Penerima Fidusia, dipidana dengan pidana penjara paling lama 2 (dua) tahun dan denda paling banyak Rp.50.000.000,- (lima puluh juta rupiah),”ungkapnya
