JAKARTA, PERKARANEWS.COM — Pengadilan Tindak Pidana Korupsi (Tipikor) Jakarta Pusat kembali menggelar sidang perkara dugaan tindak pidana korupsi Perjanjian Jual Beli Gas (PJBG) antara PT Perusahaan Gas Negara (PGN) dan Isargas/IAE Senin (8/12/2025). Dalam persidangan yang terdaftar dengan nomor perkara 86/Pid.Sus-TPK/2025/PN.Jkt.Pst tersebut, menghadirkan tiga ahli untuk memberikan keterangan bagi terdakwa Danny Praditya (mantan Direktur Komersial PGN).
Ketiga ahli yang dihadirkan adalah:
1. Dian Puji Simatupang, ahli hukum administrasi negara dan keuangan negara;
2. Dr. M. Nurul Huda, ahli hukum pidana;
3. Nindyo Pramono, ahli hukum korporasi.
Keterangan para ahli ini dinilai sangat krusial untuk memperjelas konstruksi hukum dan menilai apakah unsur-unsur dakwaan penuntut umum terpenuhi.
Dalam penjelasannya, DR. Dian Puji Simatupang menegaskan bahwa penghapusbukuan hanyalah tindakan administrasi.
“Penghapusbukuan artinya, ada tindakan administrasi dan migrasi terhadap penghapusan akun piutang, tetapi tidak menghilangkan kewajiban. Ia hanya menghapus akun piutang tersebut, tetapi di catatan lain tetap ditulis bahwa tagihan itu masih harus dijalankan.” jelasnya.
Ahli Dian merujuk pada ketentuan UU Nomor 1 Tahun 2004.
“Pasal 62 ayat (4) menyatakan bahwa penghapusbukuan mengupayakan optimalisasi manajemen, bukan menghapus kewajiban penagihan.” ujarnya.
Ia menegaskan bahwa penghapusan final harus melalui prosedur formal.
“Kalau belum ada proses persetujuan penghapusbukuan kepada Dewan Komisaris, RUPS, atau BPKP/BPKD, berarti tindakan itu belum sah.” jelasnya.
“Bagi perusahaan yang sudah go public, itu sangat berat. Dia betul-betul tidak boleh ada pelanggaran peraturan perundang-undangan di dalamnya.” tambahnya.
Kuasa hukum terdakwa Danny Praditya, FX L. Michael Shah, usai persidangan menegaskan bahwa keterangan ahli pidana Dr. M. Nurul Huda telah memperjelas bahwa dakwaan jaksa tidak sesuai dengan karakter delik Pasal 2 dan Pasal 3 UU Tipikor.
“Ahli pidana tadi dengan tegas menyatakan bahwa delik Pasal 2 dan Pasal 3 Tipikor itu adalah delik dolus, delik sengaja. Jadi stop perdebatan soal apakah orang bisa dikenakan Pasal 2 atau Pasal 3 kalau hanya karena kurang hati-hati atau tidak sengaja,” ujar Michael.
Ia menekankan bahwa unsur memperkaya diri atau orang lain harus dibuktikan melalui niat (mens rea) serta adanya keuntungan nyata yang diterima terdakwa.
“Barang siapa memperkaya diri sendiri atau orang lain itu harus dilakukan dengan sengaja. Jadi harus dicari dulu reaksinya: apakah Pak Danny memperoleh keuntungan? Kalau orang dipenjara hanya untuk memperkaya orang lain tanpa dapat apa-apa, ya itu orang gila namanya,” tegasnya.
Michael juga membantah tuduhan penyalahgunaan kewenangan terhadap kliennya, yaitu Danny Praditya.
“Kalau dia dibilang menyalahgunakan kewenangan, apa yang mau dia salahgunakan? Pak Danny sebagai Direktur Komersial tidak masuk dalam sistem pembayaran PGN. Itu jelas,” ungkapnya.
Ia menambahkan bahwa struktur internal PGN membuktikan pengambilan keputusan bersifat kolektif.
“Yang saya suka dari ahli adalah penjelasan soal kolektif kolegial. Lucu dan tidak masuk akal kalau keputusan bersama tiba-tiba ditimpakan kepada orang-orang tertentu tanpa dasar,” ujarnya.
Menurut Michael, ahli keuangan negara Dr. Dian Puji Simatupang menjelaskan bahwa kerugian negara harus bersifat nyata, bukan perkiraan.
“Dari ahli Dian menyatakan bahwa kerugian negara itu harus nyata dan pasti. Dan ‘nyata dan pasti’ itu hanya bisa dilihat dari laporan keuangan. Tidak boleh tulisannya ‘dugaan’, tidak boleh ‘kemungkinan’, apalagi ‘imajiner’.” bebernya.
Ia menyebutkan bahwa laporan keuangan PGN tahun 2020–2021 justru menyatakan bahwa uang muka (advance payment) masih dapat dipulihkan.
“PGN sendiri di laporan tahunannya menyatakan bahwa uang muka tersebut dapat dipulihkan. Jadi lucu kalau perseroan bilang belum ada kerugian, tapi di sini kita justru disuruh mengatakan sudah terjadi kerugian negara.” terangnya.
Menurutnya, persoalan ketertagihan bukan akibat perjanjian yang ditandatangani direksi.
“Uangnya belum tertagih bukan karena perjanjian, tapi karena manajemen baru tidak melakukan penagihan.” katanya.
Selanjutnya, Michael mengutip keterangan ahli bahwa penilaian soal sah atau tidaknya suatu perjanjian adalah wewenang otoritas terkait.
“Yang berhak menyatakan perjanjian ini melanggar atau tidak hanyalah otoritas terkait. Sepanjang otoritas sudah menyatakan diperbolehkan, pihak lain tidak bisa seenaknya menyatakan perbuatan melawan hukum.” katanya.
Ia juga menyinggung temuan BPK yang menyatakan pelanggaran, tetapi otoritas sektor justru menyatakan sebaliknya.
“Surat otoritas sudah ada yang menyatakan ini diperbolehkan. Bagaimana pihak lain bisa bilang ini melanggar?” tegasnya.
“Kalau memang ini dilanggar, seharusnya ada action dari regulator. Tapi tidak ada. Artinya konsisten bahwa regulator menyatakan ini diperbolehkan.” tambahnya mengutip keterangan ahli.
“Beliau juga menyatakan berulang-ulang bahwa kerugian BUMN bukan kerugian negara. MK tahun 2015 sudah tegas menyatakan hal ini.” imbuh Michael.
Michael menyampaikan bahwa menurut ahli, direksi tidak dapat dimintai pertanggungjawaban pidana selama telah melaksanakan prinsip kehati-hatian.
“Direksi tidak bisa dimintai pertanggungjawaban atas kerugian perseroan jika ia sudah melakukan fiduciary duty.” terangnya.
Penilai akhir tindakan direksi adalah RUPS dan komisaris.
“Yang menilai direksi itu sudah bertindak hati-hati adalah perseroan sendiri ketika menerima laporan tahunan.” sambungnya.
Lebih lanjut Michael mengatakan, ahli juga menjelaskan bahwa keputusan direksi terkait PJBG dilakukan melalui mekanisme kolektif–kolegial.
“Sebelum mengambil keputusan, dibentuk tim koordinasi antar-direktorat, berkonsultasi dengan SDM, semua potensi risiko sudah dijabarkan. Akhirnya direksi memutuskan secara kolektif-kolegial.” jelasnya.
“Adanya jaminan itu menambah nilai plus bahwa direksi telah bertindak hati-hati.” katanya menambahkan.
Menanggapi perbandingan jaksa dengan praktik perbankan, Michael kembali mengutip ahli. Menurutnya, terpenting dalam jual beli gas adalah ketersediaan gas dan gas mengalir, bukan nilai jaminan.

3. PJBG adalah perjanjian sah, bukan simulasi atau perbuatan melawan hukum.
4. Regulator menyatakan skema ini diperbolehkan, sehingga tidak dapat dipidana.
