JAKARTA, PERKARANEWS.COM — Penasihat hukum terdakwa Hans Falitha Hutama, Agus Sudjatmoko, menilai majelis hakim Pengadilan Tindak Pidana Korupsi (Tipikor) Jakarta Pusat tidak konsisten dalam menjatuhkan putusan terhadap kliennya dan para terdakwa lain dalam perkara dugaan korupsi impor gula bersubsidi. Hal tersebut ia sampaikan usai sidang pembacaan putusan pada Kamis (30/10/2025).
Menurut Agus, majelis hakim tidak membacakan seluruh pertimbangan hukum dalam sidang karena dianggap serupa dengan perkara terdakwa lain sebelumnya, seperti Wisnu, Indra dan kawan-kawan. Namun, ia menilai langkah itu justru menunjukkan ketidakselarasan dalam penerapan hukum.
“Majelis hakim tidak membacakan pertimbangan hukum karena dianggap sama dengan perkara sebelumnya. Tapi justru di situ letak ketidakonsistenannya. Dalam perkara Tom Lembong dan Charles Sitorus, kerugian negara hanya sekitar Rp174 miliar, sementara dalam perkara ini disebut Rp500 miliar, padahal saksi dan alat buktinya sama,” ujar Agus.
Agus juga menyoroti perubahan pandangan majelis hakim terkait unsur kerugian negara dari bea masuk, yang dalam putusan sebelumnya tidak diterima, namun kali ini justru dikabulkan.
“Terkait kerugian negara dari bea masuk, dulu majelis menyatakan tidak diterima, sekarang justru dikabulkan. Padahal buktinya sama, saksinya juga sama. Ini bentuk ketidakonsistenan majelis,” tegasnya.
Selain itu, Agus menilai hakim mengabaikan fakta hukum penting mengenai abolisi (penghapusan pidana) yang diberikan kepada mantan Menteri Perdagangan Thomas Trikasih Lembong, yang seharusnya berimplikasi terhadap para pejabat pelaksana di bawahnya, termasuk kliennya.
“Dalam pertimbangan hukum, majelis sama sekali tidak menyinggung soal abolisi Pak Lembong, padahal itu fakta hukum penting. Kalau pelaku utama sudah dinyatakan tidak bersalah karena abolisi, seharusnya bawahan yang hanya melaksanakan tugas tidak bisa dinyatakan bersalah,” jelasnya.
Lebih lanjut, Agus menjelaskan perbedaan antara amnesti dan abolisi yang menurutnya kerap disalahpahami dalam praktik hukum.
“Kalau amnesti itu orang tetap bersalah tapi diampuni, sedangkan abolisi berarti perbuatannya dianggap tidak ada, penuntutannya dihentikan. Jadi kalau sudah ada abolisi, bagaimana bisa seseorang masih dinyatakan bersalah? Itu tidak masuk akal,” tutur Agus.
Terkait langkah hukum selanjutnya, Agus menyatakan pihaknya masih akan mempertimbangkan untuk mengajukan banding atau kasasi dalam waktu tujuh hari setelah putusan dibacakan.
“Kami akan pikir-pikir dulu dalam waktu tujuh hari, seperti yang disampaikan hakim. Menerima putusan bukan berarti mengakui kesalahan, tapi kami harus mempertimbangkan banyak hal, termasuk efektivitas upaya hukum di tengah situasi seperti ini,” ungkapnya.
Meski demikian, ia menegaskan tetap menghormati putusan pengadilan namun berharap keadilan substantif tetap ditegakkan.
“Kami hormati putusan ini, tapi kami melihat ada logika hukum yang tercederai. Ketika fakta sama, bukti sama, tapi hasilnya berbeda, tentu ada yang perlu dikoreksi,” pungkasnya.
Amar Putusan dan Uang Pengganti
Dalam amar putusan yang dibacakan majelis hakim, kelima terdakwa dinyatakan bersalah dan dijatuhi hukuman 4 tahun penjara serta denda Rp200 juta subsider 4 bulan kurungan masing-masing. Mereka adalah:
1. Tony Widjaja Ng, Direktur Utama PT Angels Products,
2. Then Surianto Eka Prasetyo, Direktur PT Makassar Tene,
3. Hendrogiarto Tiwow, Direktur PT Duta Sugar International,
4. Hans Falitha Hutama, Direktur Utama PT Berkah Manis Makmur,
5. Eka Sapanca, Direktur PT Permata Dunia Sukses Utama.
Selain pidana penjara, hakim juga menghukum para terdakwa untuk membayar uang pengganti (UP) dengan nominal berbeda-beda. Namun, jumlah tersebut telah memperhitungkan penitipan uang ke rekening pemerintah (RPL) Kejaksaan Agung RI.
