BANGKA BELITUNG,PERKARANEWS — Kejaksaan Agung (Kejagung) buka suara terkait kemungkinan aktris Sandra Dewi ikut terseret kasus dugaan korupsi tata niaga komoditas timah di wilayah Izin Usaha Pertambangan (IUP) PT Timah tahun 2015-2022. Seperti diketahui, Harvey Moeis, suami Sandra Dewi, ditetapkan sebagai tersangka dalam kasus dugaan korupsi PT Timah, Sabtu (30/3/2024).
Kepala Pusat Penerangan Hukum (Kapuspenkum) Kejagung RI, Ketut Sumedana mengatakan, bisa saja ada kemungkinan Sandra Dewi ikut terseret dalam kasus serupa. Yakni apabila dalam pemeriksaan nanti ditemukan indikasi sang aktris mengetahui tindak tanduk suaminya tersebut.
“Kalau ke depannya misal dikenakan tindak pidana pencucian uang (TPPU), itu nanti penyidik yang menentukan,” kata Ketut dalam wawancara virtual.
“Tapi kita belum bisa bicara kemungkinan, karena, apa yang sudah dilakukan semua kemungkinan bisa terjadi,” ujar Ketut.
Lebih lanjut, Ketut mengatakan, saat ini Harvey Moeis harus mempertanggungjawabkan apa yang telah dilakukannya. Begitu pula, jika Sandra Dewi ikut terlibat, Ketut menegaskan bahwa hukum harus ditegakkan.
“Mereka harus bertanggung jawab apa yang mereka lakukan. Jika menyembunyikan keuangan negara, dan apa yang mereka lakukan, itu dulu inti dari para tersangka,” lanjutnya.
Sebagai informasi, dalam perkara ini tim penyidik telah menetapkan 15 tersangka. Termasuk perkara pokok dan Obstruction Of Justice (OOJ) alias perintangan penyidikan.
Dengan demikian, Harvey Moeis menjadi tersangka ke-16 dalam perkara ini.
Imbas perbuatan yang merugikan negara ini, Harvey Moeis terjerat Pasal 2 Ayat (1) dan Pasal 3 jo. Pasal 18 Undang-Undang RI Nomor 31 Tahun 1999 sebagaimana diubah dan ditambah Undang-Undang Nomor 20 Tahun 2001 jo. Undang-Undang RI Nomor 31 Tahun 1999 tentang Perubahan atas Undang-Undang RI Nomor 31 Tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi jo.Pasal 55 Ayat (1) ke-1 KUHP.
untuk mengalirkan dana hasil tindak pidana secara terus-menerus kepada pelaku pasif, maupun menjadi pemicu bagi banyak pihak untuk juga menikmati hasil dari tindak kejahatan.
Dalam kasus ini istri sebagai orang terdekat dinilai seharusnya mengetahui apabila suami memberikan sesuatu yang di luar kebiasaan, terutama dalam jumlah yang tidak sesuai pendapatan suami, istri “patut menduga” bahwa harta kekayaan tersebut hasil dari tindak pidana.
Maka yang perlu dibuktikan dari pelaku pasif terkait tidak patut menduga dan mengetahui serupa dalam pembuktian Pasal 480 KUHP yang menjelaskan adanya unsur proparte dolus dan proparte culpoos (setengah sengaja setengah lalai).
TPPU adalah proses seseorang menyembunyikan keberadaan, sumber ilegal, atau penggunaan ilegal dari pendapatan, dan kemudian menyamarkan pendapatan tersebut untuk menjadikannya tampak sah, salah satunya diperoleh dari tindak pidana korupsi.
Jika keluarga koruptor mempergunakan hasil korupsi dalam kehidupannya sehari-hari, tanpa mengetahui bahwa harta tersebut hasil dari korupsi, maka dapat didakwa sebagai pelaku TPPU pasif dan dapat dipidana dengan pidana penjara paling lama 5 (lima) tahun dan denda paling banyak Rp1 miliar.
Oleh karena itu, sanksi hukum tersebut perlu diberikan terutama untuk mencegah banyaknya pihak yang secara sengaja maupun sembarang menerima hasil kejahatan.
Dengan hanya di terapkan Undang-Undang Minerba ataupun Undang-Undang Tipikor Rasanya kurang adil, tidak ada efek jera dan kedepannya jika di temukan lagi dengan kasus yang sama tidak menutup kemungkinan maka akan jadi suatu perbandingan jika Aon CS tidak di terapkan dengan Pasal TPPU. (Awam Babel)
