JAKARTA, PERKARANEWS.COM — Sidang lanjutan perkara dugaan korupsi fasilitas kredit macet Bank Negara Indonesia (BNI) dengan terdakwa Lia Hertika Hudayani dan lainnya digelar di Pengadilan Tindak Pidana Korupsi (Tipikor) Jakarta Pusat. Persidangan ini menyoroti dugaan penyalahgunaan fasilitas kredit yang menyebabkan kerugian keuangan negara sebesar Rp34,5 miliar.
Dalam persidangan, Jaksa Penuntut Umum (JPU) menghadirkan sejumlah saksi dari pihak BNI, termasuk Trisia Marbun, Elfian Trisna Sundawa, Vivi Puspa Juwita, Siti Fatiah Rahma Cita, dan Lina Apriyanti. Majelis hakim dipimpin oleh Fajar Kusuma Aji, sementara Lia Hertika Hudayani didampingi oleh penasihat hukum Erdi Surbakti dan rekan.
Penasihat hukum Lia Hertika, Erdi Surbakti, menilai terdapat kejanggalan dalam konstruksi perkara yang menjerat kliennya. Menurutnya, Lia hanyalah pegawai dengan tugas administratif yang tidak memiliki kewenangan dalam penentuan keputusan kredit.
“Kredit yang dimaksud merupakan kredit kecil atau UMKM yang di-cover oleh asuransi. Namun, yang menentukan apakah asuransi itu ditagih atau tidak bukan kewenangan Lia, melainkan bagian bisnis,” ujar Erdi.
Erdi menegaskan bahwa tanggung jawab utama pemberian kredit berada pada wakil pimpinan cabang dan penyelia, bukan pada Lia. “Wakil pemimpin cabang yang merupakan atasan Lia itu adalah penentu kredit. Tapi anehnya, dia tidak dijadikan tersangka maupun terdakwa,” tegasnya.
Erdi meminta agar majelis hakim menghadirkan saksi tambahan, khususnya dari pihak yang memiliki kewenangan penuh dalam proses pemberian kredit. “Harapan kami, saksi-saksi penting seperti wakil pemimpin cabang bisa dihadirkan. Karena kalau hanya berhenti pada saksi yang belum menjawab persoalan pokok, maka kebenaran materil tidak akan terungkap,” katanya.
Persidangan akan kembali digelar pekan depan dengan agenda lanjutan pemeriksaan saksi dan pembuktian. Jaksa menjerat para terdakwa dengan Pasal 2 ayat (1) Jo. Pasal 18 UU No. 31 Tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi dengan ancaman pidana maksimal penjara seumur hidup. (Yuko)
