JAKARTA, PERKARANEWS.COM — Sidang lanjutan kasus dugaan korupsi penyaluran kredit di Bank Negara Indonesia (BNI) kembali digelar di Pengadilan Tindak Pidana Korupsi (Tipikor) Jakarta Pusat, Selasa (7/10/2025).
Kasus yang menjerat terdakwa Lia Hertika Hudayani, Ferry Syarfariko, Nazal Gilang Ramadhan, dan Lilys Yuliana alias Sansan (DPO), ini diduga menimbulkan kerugian negara sebesar Rp34,51 miliar.
Sidang dengan nomor perkara 88-89-90/Pidsus-TPK/2025 tersebut menghadirkan tiga saksi dari BNI, yakni Ari Fiandi Nurul Huda (Orix/CRM BNI), Haryati (Retail Credit Officer), dan Abner (Manager Business BNI).
Sidang dipimpin oleh Ketua Majelis Hakim Fajar Kusuma Aji, S.H., M.H.
Saat masa skors persidangan, penasihat hukum terdakwa Lia Hertika Hudayani, Erdi Surbakti, menilai dakwaan Jaksa Penuntut Umum (JPU) terlalu lemah karena tidak didukung audit resmi atas kerugian negara.
“Ketiga saksi dari BNI itu hanya menyebut adanya audit internal. Padahal, sesuai ketentuan dan putusan Mahkamah Konstitusi, kerugian negara harus bersifat pasti dan terukur berdasarkan audit lembaga resmi seperti BPK. Kalau masih audit internal, itu sama saja mendakwa orang tanpa dasar hukum,” tegas Erdi Surbakti kepada wartawan.
Menurut Erdi, dakwaan tersebut tidak memenuhi unsur formil dan materiil sebagaimana diatur dalam UU Tipikor.
“Ini seperti memaksakan tuduhan tanpa dasar hukum yang kuat. Padahal, audit internal itu bukan bukti kerugian negara yang sah,” katanya.
Lebih lanjut, Erdi menyoroti kejanggalan dalam struktur tanggung jawab internal BNI. Ia menyebut bahwa Lia Hertika, yang saat itu menjabat penyelia penyedia kredit, justru dijadikan terdakwa dan disebut sebagai penanggung jawab atas kerugian Rp24 miliar di BNI Jakarta Kota dan Rp14 miliar di BNI Daan Mogot.
“Dalam struktur kerja BNI, penyelia bukan pengambil keputusan akhir kredit. Yang berwenang menyetujui itu adalah wakil kepala cabang. Tapi anehnya, justru Lia yang diseret. Ada apa ini?” ujar Erdi dengan nada heran.
Ia menilai, penegakan hukum dalam kasus ini tidak proporsional dan cenderung tebang pilih.
“Wakil kepala cabang yang punya wewenang menyetujui pinjaman justru tidak diproses. Sementara Lia, yang hanya pelaksana di bawah, malah dijadikan terdakwa. Ini jelas rancu,” tambahnya.
Erdi juga menyoroti adanya tersangka buron (DPO) bernama Lilys Yuliana alias Sansan, yang diduga berperan besar dalam mengatur ratusan debitur fiktif.
“DPO ini bukan orang kecil. Dia aktor intelektual yang bisa mendesain ratusan debitur fiktif. Kami menduga ada keterlibatan internal BNI juga yang belum dikaji serius oleh penegak hukum,” ujar Erdi.
Ia meminta agar aparat penegak hukum tidak tebang pilih dalam penanganan kasus ini.
“Kalau mau adil, semua pihak yang punya kewenangan harus diperiksa. Jangan Lia yang justru dikorbankan. Apalagi dia punya anak kecil dan selama ini hanya menjalankan tugas sesuai arahan atasan,” tegasnya.
Sementara dalam persidangan yang sama, saksi Ari Fiandi Nurul Huda (CRM BNI Jakarta Kota) menjelaskan peran sejumlah pejabat bank dan mekanisme verifikasi lapangan terhadap kredit bermasalah tersebut.
Saat ditanya JPU mengenai Feri Safari Koya, Wakil Pimpinan Cabang BNI Jakarta Kota, Ari menegaskan bahwa tidak ada kewajiban formal bagi pejabat tersebut untuk hadir dalam pengecekan lapangan (On The Spot/OTS).
“Secara pekerjaan tidak ada kewajiban bagi wakil pimpinan untuk datang ke OTS. Namun sesuai tugasnya, wakil pimpinan tetap harus memastikan hasil verifikasi dan analisa kredit dari penyelia sesuai dengan ketentuan,” terang Ari di hadapan majelis hakim.
Ia menambahkan bahwa terdakwa Lia Hertika hadir dalam proses verifikasi lapangan kredit KUR dan refinancing mesin di Cabang Daan Mogot maupun Jakarta Kota.
“Dari hasil dokumentasi foto yang kami terima, saudari Lia hadir dalam proses verifikasi lapangan, baik untuk kredit refinancing mesin maupun KUR mikro di Daan Mogot,” jelasnya.
Ari menegaskan tidak ditemukan pelanggaran administratif yang dilakukan Lia.
“Sejauh pemeriksaan kami, tidak ada temuan pelanggaran langsung oleh saudari Lia dalam proses pengajuan kredit,” ujarnya.
Dalam pemeriksaan lanjutan, JPU menyinggung daftar debitur yang sebagian besar merupakan karyawan PT PJB beserta keluarganya, perusahaan tempat Yuliana (alias Sansan) diketahui menjabat sebagai direktur. Ari juga membenarkan hal tersebut.
“Ya, benar. Dari pemeriksaan kami, nama-nama itu merupakan karyawan PT PJB beserta keluarganya yang digunakan sebagai calon peminjam KUR di BNI,” kata Ari.
Ia menuturkan bahwa BNI sempat menghentikan sementara proses kredit untuk memperdalam informasi terkait hubungan para debitur dan pihak internal.
“Kami dapat arahan dari kantor pusat untuk distop dulu, karena ada hubungan dengan para debitur supaya bisa kami gali informasi lebih jauh,” ungkapnya.
Selain itu, Ari juga mengungkapkan fakta penting terkait aliran dana debitur yang ternyata dikuasai oleh Yuliana (Sansan), lalu diputar kembali untuk membayar angsuran debitur lain.
“Dari hasil konfirmasi awal, dana itu dikuasai oleh Yuliana dan Sansan. Dana tersebut diputar sebagai angsuran untuk debitur lain, dan teknisnya disetorkan melalui saudara Gilang,” ujar Ari Fiandi.
Dalam perkara ini, Lia Hertika Hudayani dan rekan didakwa melanggar Pasal 2 ayat (1) Jo. Pasal 18 Undang-Undang Nomor 31 Tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi, sebagaimana diubah dengan UU Nomor 20 Tahun 2001, juncto Pasal 55 ayat (1) ke-1 KUHP dan Pasal 64 ayat (1) KUHP.
Subsider, mereka juga dijerat dengan Pasal 3 UU Tipikor.
Majelis hakim yang diketuai Fajar Kusuma Aji, S.H., M.H. menunda sidang untuk pemeriksaan saksi berikutnya dari pihak internal BNI dan pihak eksternal yang diduga terkait dengan penyaluran kredit fiktif.
“Kami percaya hakim cukup jeli melihat duduk perkara ini. Dari akhir persidangan nanti akan terlihat apakah unsur-unsur formil dan materiil terpenuhi atau tidak,” tutup Erdi Surbakti optimistis. (Yuko)
