JAKARTA, PERKARANEWS.COM — Kasus dugaan korupsi di tubuh PT Pertamina kembali menggemparkan publik. Dugaan penyimpangan dalam impor Bahan Bakar Minyak (BBM) dan penjualan solar nonsubsidi yang disebut-sebut merugikan negara hingga Rp 285 triliun lebih, kini resmi memasuki babak baru di Pengadilan Tindak Pidana Korupsi (Tipikor) Jakarta Pusat, Kamis (9/10/2025).
Dalam sidang dengan agenda pembacaan surat dakwaan, pejabat dan mantan pejabat tinggi Pertamina dihadirkan sebagai terdakwa, yakni:
1. Riva Siahaan, Direktur Pemasaran dan Niaga PT Pertamina Patra Niaga periode Oktober 2021–Juni 2023, sekaligus Direktur Utama periode Juni 2023–2025.
2. Sani Dinar Saifuddin, Direktur Feedstock and Product Optimization PT Kilang Pertamina Internasional.
3. Maya Kusmaya, Vice President Trading & Other Business PT Pertamina Patra Niaga (2021–2023) sekaligus Direktur Pemasaran Pusat dan Niaga.
4. Edward Corne, pejabat di berbagai posisi strategis dalam fungsi impor dan ekspor produk BBM di PT Pertamina dan Subholding Pertamina Patra Niaga periode 2019–2022.
Jaksa Penuntut Umum (JPU) dalam dakwaannya membeberkan dua inti penyimpangan besar yang menjadi dasar perkara, yakni impor produk kilang/BBM dan penjualan solar nonsubsidi di bawah harga wajar.
1. Impor Produk Kilang/BBM
Jaksa menjelaskan, terdakwa Edward Corne diduga memberikan perlakuan istimewa kepada dua perusahaan asing, BP Singapore Pte Ltd dan Sinochem International Oil (Singapore) Pte Ltd, dalam proses lelang pengadaan gasoline RON 90 dan RON 92 — yang dikenal masyarakat sebagai Pertalite dan Pertamax.
“Dengan cara membocorkan informasi alpha pengadaan kepada BP Singapore Pte Ltd dan Sinochem International Oil (Singapore) Pte Ltd serta memberikan tambahan waktu penawaran kepada BP Singapore Pte Ltd meskipun sudah melewati batas waktu penyampaian penawaran,” ujar jaksa di persidangan.
Selanjutnya, Edward mengusulkan dua perusahaan tersebut sebagai calon pemenang tender melalui memo ke terdakwa Maya Kusmaya, yang kemudian diteruskan ke Riva Siahaan untuk disetujui.
2. Penjualan Solar Nonsubsidi
Dalam dakwaan lain, jaksa menyebut Riva Siahaan menyetujui penjualan biosolar kepada sejumlah konsumen industri tanpa memperhitungkan harga dasar (bottom price).
“Bahkan di bawah harga pokok penjualan atau HPP serta lebih rendah dari harga dasar solar bersubsidi, yang pada akhirnya menimbulkan kerugian bagi PT Pertamina Patra Niaga,” tegas jaksa.
Setidaknya, 14 perusahaan disebut menerima harga solar di bawah ketentuan, yang menimbulkan kerugian besar bagi keuangan dan perekonomian negara.
Jaksa memaparkan hasil perhitungan gabungan dari kerugian keuangan negara dan kerugian perekonomian negara, yang nilainya fantastis:
Kerugian Keuangan Negara USD 2,7 miliar atau sekitar Rp 45,1 triliun, Ditambah Rp 25,4 triliun, dengan Total: Rp 70,5 triliun.
Keuntungan ilegal dari selisih impor BBM dan pembelian dalam negeri: Rp 43,1 triliun, Total: Rp 215,1 triliun
Dengan demikian, total kerugian mencapai Rp 285,18 triliun, angka yang disebut jaksa bisa berbeda tergantung kurs dolar yang digunakan dalam penghitungan.
Persidangan yang digelar di Pengadilan Tipikor, Jakarta Pusat itu dipimpin oleh Ketua Majelis Hakim Fajar Kusuma Aji, S.H., M.H., dengan nomor perkara 96-97-99-103/Pid.Sus-TPK/2025.
Dalam dakwaannya, para terdakwa disebut telah melakukan penyimpangan mulai dari hulu hingga hilir, mencakup ekspor dan impor minyak mentah, impor BBM, sewa terminal, hingga manipulasi harga solar nonsubsidi.
“Perbuatan para terdakwa telah mengakibatkan kerugian negara sebesar Rp 285.185.919.576.620 (Rp 285,18 triliun),” tegas jaksa membacakan surat dakwaan.
Keempat terdakwa dijerat dengan Pasal 2 ayat (1) atau Pasal 3 juncto Pasal 18 Undang-Undang Tindak Pidana Korupsi (UU Tipikor) juncto Pasal 55 ayat (1) ke-1 KUHP tentang perbuatan memperkaya diri sendiri atau orang lain yang dapat merugikan keuangan negara.
Kasus ini merupakan bagian dari penyelidikan besar Kejaksaan Agung terkait dugaan korupsi dalam tata kelola minyak mentah dan produk kilang di Pertamina (Persero), subholding, dan kontraktor kerja sama (KKKS) periode 2018–2023.
Penyimpangan disebut terjadi secara sistematis dan berjenjang, mulai dari pengadaan hingga distribusi BBM ke pasar domestik. Sidang selanjutnya dijadwalkan menghadirkan saksi-saksi kunci dari internal Pertamina serta pihak asing yang disebut terlibat dalam proses tender. (Yuko)
