JAKARTA,PERKARANEWS – Hak memperoleh informasi merupakan hak asasi manusia dan keterbukaan informasi publik merupakan salah satu ciri penting negara demokratis yang menjunjung tinggi kedaulatan rakyat untuk mewujudkan penyelenggaraan negara yang baik sesuai UU Nomor 14 tahun 2008 tentang keterbukaan informasi publik.
Tim Pansus Stabilitas Harga Tandan Buah Segar Sawit dan Syarat Perizinan Perkebunan Sawit DPRD Provinsi Kepulauan Bangka Belitung saat ini terus bekerja dengan mengumpulkan data ke seluruh stakeholder termasuk terkait izin Hak Guna Usaha (HGU) Perusahaan Perkebunan Kelapa Sawit yang ada di Provinsi Kepulauan Bangka Belitung.
“Guna mendapatkan dasar bagi Tim Pansus DPRD dalam mendapatkan informasi, dirasa perlu berkoordinasi dengan Komisi Informasi Pusat (KIP) RI sebagai lembaga mandiri yang berfungsi menetapkan petunjuk teknis standar layanan informasi publik dan telah banyak menyelesaikan sengketa informasi publik,” ujar Beliadi, Wakil Ketua DPRD Provinsi Kepulauan Bangka Belitung dalam pertemuan dengan KIP RI di Jakarta, Rabu (11/10/2023).
Syawaludin Komisioner Penyelesaian Sengketa Informasi KIP RI, yang menerima konsultasi menyampaikan berdasarkan Keputusan KIP Nomor 057/XII/KIP-PS-M-A/2015 dan dikuatkan oleh Putusan Kasasi Mahkamah Agung Nomor: 121 K/TUN/2017 yang menyatakan nama pemegang izin HGU, tempat/lokasi, luas HGU yang diberikan, jenis komiditi, peta areal HGU yang dilengkapi titik koordinat merupakan informasi publik yang bersifat terbuka.
Ditambahkannya bahwa kedua keputusan tersebut dapat dijadikan sebagai yurisprudensi terkait keterbukaan informasi publik izin Hak Guna Usaha (HGU) Perusahaan Perkebunan Kelapa Sawit termasuk di Provinsi Kepulauan Bangka Belitung.
Mengacu pada hal diatas politisi partai Gerindra ini menekankan bahwa secara yurisprudensi, maka seluruh stakeholder dan pihak terkait yang mempunyai akses data terkait perizinan HGU maka harus memberikan informasi yang memang menjadi hak publik untuk tahu.
“Saya harap kepada stakeholder ataupun pihak terkait dapat memberikan informasi ini kepada publik termasuk kepada Tim Pansus DPRD sehingga apabila tidak dilakukan maka dapat dikenakan ketentuan pidana sesuai aturan yang berlaku,” sambungnya ini sebelum menutup pertemuan.
