Dimana sebelumnya, kewenangan berada di masing-masing Otda, kini tali kekang regulasi berada dalam genggaman pusat.
Selain itu, UU No 3/2020 juga memperkenalkan izin baru yaitu Surat Izin Pertambangan Batuan (SIPB) yang kewenangannya didelegasikan ke pemerintah provinsi. Meski begitu, provinsi di tiap wilayah penghasil SDA tetap mendapatkan manfaat, yang dinilai manfaatnya akan lebih besar setelah nantinya akan diatur oleh regulasi lanjutan berupa PP (Peraturan Pemerintah).
Dalam UU No 3/2020 diatur juga soal PNT atau peningkatan nilai tambah Mineral dan Batubara. Definisinya juga diatur, berbeda seperti UU sebelumnya
Terkait definsi pengelolaan dan pemanfaatan batubara. Dalam pelaksanaan PNT mineral, UU No. 3/2020 mencakup juga dua faktor penting yakni, faktor kelayakan ekonomi (economic feasibility) dan akses pasar (forward linkage), yang tidak diatur dalam UU NO. 4/2009. Meski demikian, regulasi lebih detil lagi akan dijabarkan dalam PP sehingga pelaksanaannya nanti sesuai dengan yang diharapkan.
Dengan demikian, sesuai dengan isi dan semangat UU Minerba 3/2020 tadi, sebagian pelaku Industri Pertambangan berharap, UU ini bisa membuka setiap gate barrier atau pintu halangan yang selama ini menghambat akselerasi laju pertumbuhan ekonomi baik di daerah maupun pusat.
Yang lainnya adalah, untuk peran serta pemerintah daerah diharapkan bisa bersinergi dengan menjadikan UU No 3/2020 ini sebagai acuan yang mengikat untuk kemudian di implementasikan dalam peniadaan peraturan daerah yang terindikasi menghambat Program Pemerintah Pusat.
Beberapa pekan yang lalu, pengiriman mineral ikutan berupa pasir zirkon ke pulau Kalimantan oleh PT Putra Prima Mineral Mandiri (PMM) yakni perusahaan penambangan yang bergerak dalam pengelolaan mineral ikutan dari sisa limbah produksi pasir timah, jadi polemik di masyarakat Bangka Belitung (Babel). Bisa disebut sebagai pemicunya adalah aksi organisasi atau lembaga swadaya masyarakat Pimpinan Daerah (PD) Indonesia Berkerja (Inaker) Kabupaten Bangka yang diketuai oleh Leonardo. Pihaknya menuduh pengiriman zirkon ke luar daerah pulau Bangka melanggar aturan.
Meskipun setelah ramai pro kontra tadi, Gubernur Kepulauan Bangka Belitung bersama Kapolda, dan Danrem 045 Gaya segera memfasilitasi Ormas Inaker yang dipimpin oleh Leonardo -seorang guru di SLTS Kabupaten Bangka- meninjau ke lokasi pengelolaan sementara penampungan zirkon PT PMM di kawasan industri lintas timur Desa Air Anyir Kecamatan Merawang Kabupaten Bangka.
Saat itu, Gubernur Babel duduk semeja langsung dengan Direktur PT PMM, Ketua PD Inaker Bangka, dimaksudkan agar Leonardo dapat mendengar langsung penjelasan dari direktur PT PMM, dan melihat secara langsung dokumen perizinan yang dimiliki oleh PT PMM sudah terpenuhi persyaratan dan kelayakan untuk pengiriman zirkon ke pulau Kalimantan. Senin (2/08/2021).
Dalam kunjungan unsur Forkopimda Babel (Gubernur H. Erzaldi, Kapolda Babel Irjen Anang Syarif Hidayat, Danrem 045 Gaya Brigjend Jangkung) telah memberikan penjelasan kepada Leonardo dan rekan-rekannya terkait protes mereka terhadap pengiriman pasir zircon PT.PMM ke Kalimantan untuk diolah dan diproses lagi sehingga menjadi lebih bernilai dan layak di ekspor ke luar negeri.
“PT. PMM sudah mendapatkan izin pengiriman pada tahun 2019 lalu dengan ketentuan sesuai Perda Provinsi Bangka Belitung No.1 Tahun 2019 bahwa pasir zircon boleh dikirim ke luar negeri / ekspor setelah mencapai kadar 65 % ( Persen ) dan sesuai dengan ketentuan dari Perda tersebut yang mengatur pengelolaan mineral ikutan dan produk samping Timah di Provinsi Babel apa yang dilakukan oleh PT.PMM tidak melanggar aturan asalkan pasir zircon itu di olah hingga mencapai kadar 65 %”, jelas Gubernur saat itu kepada Leonardo dan rekan-rekannya.
Namun, penjelasan yang diberikan Erzaldi tidak membuat oknum PNS tadi dan rekan-rekannya, lantas mengerti dan paham, justru seolah tak puas atas apa yang disampikan Gubernur Babel kepada mereka, malah membuat leonardo dan rekannya memberikan keterangan tetap melakukan pelaporan PT PMM diduganya melanggar aturan hukum didepan awak media yang hadir pada saat kunjungan Gubernur dan Forkopimda Babel di Pabrik PT. PMM (02/08/2021).
Dalam ungkapan rasa tak puas leonardo dan rekan-rekannya mereka mengklaim akan menulis surat sampai ke Presiden Republik Indonesia Joko Widodo, hal itulah yang kemudian menuai berbagai komentar masyarakat Bangka Belitung terhadap Oknum PNS itu dan kemudian viral diberitakan di banyak media online yang ada.
Bahkan, sikap dan tindak ketidakpuasan menuai kecaman dari elemen masyarakat Bangka Belitung saat Leonardo didampingi pengacara hukumnya melaporkan secara resmi ke Polda Kepulauan Bangka Belitung, dugaan ada pelanggaran atas asal usul barang yang dikelola dan ditampung oleh PT PMM bukan dari wilayah IUP-nya, beberapa hari yang lalu.
Padahal dalam suatu kesempatan pihak PT PMM sudah menjelaskan bahwa mereka sudah beberapa kali melakukan mengirim zirkon ke pulau Kalimantan bukan baru sekarang, dan zirkon yang dikirim tersebut merupakan stock file mereka yang diperoleh pada tahun 2019 – pertengahan tahun 2021 sesuai dengan RKAK.
Tak pelak saat itu, Ketua Kantor Dagang dan itndustri (Kadin) Bangka Belitung Johan Murod SIP. MM yang juga salah satu tokoh Pejuang Provinsi Kepulauan Bangka Belitung, kepada jejaring media ini mengatakan apa yang dilakukan oleh Leonardo itu menurut Johan Murod tidak mencerminkan pribadi seorang pendidik yang mendukung Kepala daerah dalam meningkatkan perekonomian di Bangka Belitung,
“Apa yang dilakukan oleh Oknum PNS bernama Leonardo itu tak patut dicontoh oleh PNS yang ada di Babel ini, harusnya ia sebagai tenaga pendidik yang digaji Pemerintah berfikir dan membuat sebuah inovasi yang berguna bagi dunia pendidikan yang nantinya akan membawa harum nama Bangka Belitung di tingkat nasional hingga Internasional,” tegas Johan Murod.
Seharusnya seorang abdi negara yang dibayar gajinya oleh negara wajib bersyukur dan mendukung pemerintah agar pemerintah tiap bulannya tak kesulitan untuk mencari sumber pendapatan negara untuk membayar gaji PNS yang salah satunya termasuk Gaji Leonardo itu sendiri, “Berfikirlah yang positif dan berguna bagi orang banyak dan janganlah berpikir atas pengaruh orang lain yang negatif terhadap pemerintah, Gaji PNS itu sumbernya darimana kita harus paham itu’, ucap Johan Murod yang dikenal dengan sebutan panglima.
Selain itu, elemen masyarakat lainnya yang menanggapi oknum PNS aksi yang membuat gaduh iklim investasi dan kondusifitas masyarakat, datang dari pemerhati sosial kemasyarakatan dan ormas, Meyrest Kurniawan Lelaki 41 tahun yang kesehariannya bergelut dan aktif di dalam sosial kemasyarakatan pada jejaring media pers Babel mengungkapkan pandangannya terhadap Oknum Guru yang protes terhadap pengiriman pasir zircon ke kalimntan oleh PT,PMM.
Kurniawan sebut, sebagai seorang tenaga pendidik harusnya Leonardo menyadari betapa pentingnya sebuah ilmu pengetahuan yang harus ia miliki sebagai tenaga pendidik agar anak didiknya kelak dapat menciptakan sebuah inovasi baru yang dapat berguna bagi masyarakat luas dan berdampak positif bagi perekonomian di Bangka Belitung khususnya.
“ Bagi saya apa yang dilakukan Leonardo itu tidak ada salahnya karena menunjukkan sebenarnya ia peduli dengan Bangka Belitung, ia perduli dengan pemerintah dan lingkungan yang ada serta kekayaan alam yang diberikan Tuhan untuk masyarakat Babel, namun lebih baik lagi jika memang peduli dengan kekayaan alam Babel ini ia harusnya berfikir bagaimana caranya menyelamatkan pasir timah yang terus dijarah dibeberapa tempat di Kabupaten Bangka dimana dirinya tinggal dan bekerja disana”, ungkap Meyrest saat di wawancara di kediamannya di Pangkalpinang, Kamis (19/08/2021).
Meyrets memberikan gambaran kepada Leonardo, jika memang ia peduli dengan kekayaan alam yang ada di Babel ini maka jangan biarkan para penambang timah ilegal menjarah dan mencuri pasir timah dari dalam perut bumi Bangka Belitung ini, seperti di perairan laut Belinyu Kabupaten Bangka, wilayah perairan batu dinding, mengkubung, bakit , tanjung batu, mapur, teluk uber, romodong dan sungai tirus serta masih banyak lagi tambang ilegal yang beroperasi dan mencuri harta kekayaan Bangka Belitung di tempat dimana Leonardo dan rekan-rekannya tinggal, lantas kemana PD Inaker Bangka yang memprotes pengiriman zircon PT PMM yang justru sudah membayar pajak/royalti kepada pemerintah daerah.
“Jika memang peduli, kawan-kawan ormas Bangka yang ikut mendukung Leonardo, ada kejahatan yang besar didepan kalian, yang menjarah harta kekayaan daerah kalian, yang merampas hak-hak nelayan yang menghidupi keluarganya dari hasil melaut, dengan mencuri pasir timah di Negeri Serumpun sebalai yang kita cintai ini para penambang ilegal itu harus kita hentikan,” seru Meyrest.
Ditambahkannya, Kerugian yang ditimbulkan oleh maraknya penambangan ilegal itu sangat fantastis nilainya, apalagi saat ini banyak modus operandi pencurian pasir timah dengan cara terang-terangan, memakai CV hingga PT untuk mengelabui masyarakat dan pemerintah tanpa ada rasa peduli akan dampak yang ditimbulkan nantinya.
